DEC 41993 <br />BOOK 9 `,� r_ 953 <br />leave the area in at least as good a condition as it was before <br />this project was started. <br />Director Pinto responded that staff will follow the Board's <br />direction. He was concerned that no matter what we do, some of the <br />residents in that area will never be happy. He stressed that he <br />was not trying to defend the contractor. <br />Vice Chairman Tippin felt that we should withhold more than <br />$5,000 until the problems are resolved. He felt that we should do <br />the best we can to return the area to the condition it was in <br />before this project was started, but he agreed with Director Pinto <br />that some of the people who live there will never get over the fact <br />that the County paved the road and then tore it up to put in <br />utilities. <br />Commissioner Eggert reported that she drove through the <br />neighborhood the previous day, and the job did not look complete to <br />her. She asked whether the 5 problems listed in staff's memorandum <br />were resolved. <br />Duke Oster, environmental engineer from the Utilities <br />Department, reported that he discussed the 5 items listed on <br />staff's memorandum with Darrell McQueen, the consultant on this <br />project, Mr. Bates of A.O.B. Underground, and Tyler Tillis from the <br />Public Works Department. He was assured by all three individuals <br />that the problems were resolved. <br />Commissioner Macht commented that we must do our best to <br />provide proper maintenance when we do these projects, but we should <br />explain to the 'residents that it may not be possible to make <br />everything exactly like it was before this project was started. <br />O'Neal Bates, President of A.O.B. Underground, contended that <br />the County has owed his company over $50,000 since July and it is <br />unacceptable for the County to continue to withhold money that is <br />due him. He stressed that his company trusted the County and did <br />extra work without requiring change orders, and this project has <br />exceeded the contract amount by about $30,000. <br />MOTION WAS MADE by Commissioner Adams, SECONDED by <br />Commissioner Eggert to pay the contractor 50 percent <br />of the $52,612.65 that is owed, hold the balance <br />until next week's BCC meeting, and take final action <br />at that time. <br />Under discussion, Commissioner Adams stated that the following <br />specific problems must be resolved: (1) some of the swales were <br />34 <br />
