Vitunac, County Attorney <br />DATE: December 8, 1993 <br />RE: ELECTRICAL POWER LINE ISSUE <br />At the November 17, 1993, meeting of the Legislative Delegation the <br />County made a presentation supporting the Treasure Coast Council of <br />Local Government's proposed bill which would ask for a public meeting <br />requirement before electrical utilities could construct certain trans- <br />mission lines. After the presentation Senator Patsy Kurth expressed an <br />interest to me in helping to develop such a bill. Our office and the <br />Community Development Department prepared the attached proposed general <br />bill and submitted it to the Senator's Office. <br />Simultaneously with the Delegation presentation the County's Community <br />Development Department began considering adoption of local regulations <br />to address the power line issue. One of those local regulations would <br />be the an public meeting requirement as was presented to the <br />Delegation for a state-wide regulation. However, after meeting with the <br />attorneys for Florida Power & Light Company, our "office and the <br />Community Development Department agree that state law prohibits counties <br />from adopting transmission line regulations as part of land development <br />regulations. Any locally adopted regulations thus would have to be <br />adopted under the police power rather than the land development power. <br />Since we are informed that neither FPL nor the City of Vero Beach has <br />plans in the next several years for the construction of new transmission <br />lines, the question arises whether we should delay adopting local <br />regulations and proceed with attempting to get state-wide regulations <br />passed. <br />35 <br />BOOK 91 F'AG� 25 <br />L.
