I <br />DEC 14 1993 <br />BOOK 91 F.�lcr655 <br />I recommend delaying local regulation adoption until the Legislature has <br />had an opportunity to deal with the issue at the state level since there <br />is still some legal issue concerning our authority to adopt these <br />regulations even under the police power. <br />REQUESTED ACTION: Request direction from the Board whether to proceed <br />with the adoption of a County ordinance similar to the proposed state <br />law amendment or whether to wait until the Legislature has dealt with <br />the matter on a state-wide basis. <br />Commissioner Macht suggested that we wait and see if the State <br />enacts legislation. <br />Commissioner Adams predicted that the State most likely will <br />not do anything, and she wanted to move forward regardless of <br />whether the City of Vero Beach or Florida Power & Light have plans <br />for more lines in the near future. <br />Commissioner Eggert preferred to give the State until April to <br />take action. However, she agreed that the Board should definitely <br />enact an ordinance if the State does not do anything by April. She <br />hoped that the City of Vero Beach Utilities Department and Florida <br />Power & Light realize that people want an opportunity to be heard <br />before high voltage transmission lines are placed in their <br />neighborhoods. <br />COMMISSIONER ADAMS MADE A MOTION TO PROCEED IMMEDIATELY <br />WITH THE ADOPTION OF A COUNTY ORDINANCE. <br />THE MOTION DIED FOR LACK OF A SECOND. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Macht, the Board unanimously (4-0, <br />Chairman Bird being absent) agreed to forward the <br />proposed bill to the State of Florida, and if the <br />State fails to act on it in a positive manner by <br />April, to schedule hearings to consider a County <br />ordinance providing a public meeting requirement on <br />certain transmission line siting actions. <br />PUBLISHING OF LEGAL NOTICES <br />The Board reviewed the following memos dated December 3, 1993: <br />36 <br />
