Vitunac, County Attorney <br />DATE: December 3, 1993 <br />SUBJECT: PUBLISHING OF LEGAL NOTICES <br />The attached memorandum from Terry O'Brien indicates the possibility <br />of saving money on the cost of legal advertising which we presently <br />place without bid in the Vero Beach Press Journal. It appears that <br />the "Sun" newspaper may qualify as a legal newspaper. Therefore, <br />we may wish to consider going out to bid under the conditions <br />outlined in the attached memorandum. <br />Staff Recommendation: <br />Direct Purchasing Department to prepare bids for publishing legal <br />advertisments and other official notices for calendar year 1994 in <br />accordance with the attached memorandum. <br />TO: Charles P. O'Brien - Assistant County Attorney <br />DATE: December 3, 1993 <br />SUBJECT: PUBLICATION OF LEGAL NOTICES <br />As a subscriber and reader of the Vero Beach Sun newspaper, I <br />wondered why no legal notices appeared in the paper. My curiosity <br />has lead to this memorandum. <br />Pursuant to Section 50.031, F.S. , legal notices must be published "in <br />a newspaper which at the time of such publication shall have been in <br />existence for -one year and shall have been entered as second-class <br />mail matter at a post office in the County..." <br />The Vero Beach Sun has been published for approximately 40 weeks <br />under the masthead "Vero Beach Sun"; liowever, the "Sebastian Sun" <br />has been printed for more than 14 years. As I understand it, these <br />are the same newspapers with news stories weighted more to the <br />community set forth in the masthead. Thus, it would appear that the <br />"Sun" could be considered as meeting the statutory criteria now or in <br />a worst case in 12 weeks from now. The "Sun" under both mastheads <br />has been entered as second-class mail matter. The "Sun" does not <br />have paid subscribers but I understand that they plan to place <br />newsracks in the County which will require insertion of a coin to <br />obtain the paper and that may be sufficient under Section 50.11, <br />F . S . , however, as long as it is "available to the public generally" <br />(AGO 73-149) that also may be sufficient without regard to sale <br />especially if you read Section 50.031, F .
