DEC I A 1001 BOOK 91 FADE 223 <br />On January 28, 19931 the Planning and Zoning Commission granted <br />preliminary PD approval for Windsor Phase IV. Subsequently, a land <br />development permit was issued, and with the exception of some <br />roadway treatment, sodding, and signage work, the project <br />improvements were completed. The developer, Windsor Properties, <br />Inc., through its agent Knight, McGuire and Associates, Inc., is <br />now requesting final plat approval and has submitted the following: <br />1. A final plat in conformance with the originally approved <br />preliminary plat; <br />2. A certified engineer's cost estimate for the remaining <br />required improvements; <br />3. A contract for required improvements and cash escrow to <br />guarantee completion of the remaining required improvements. <br />ANALYSIS: <br />The applicant has constructed most of the subdivision improvements <br />and will be bonding -out for future construction of the remaining <br />required improvements (roadway treatment, sodding, signage). The <br />county attorney's office has reviewed and approved the submitted <br />contract for construction and cash escrow. The public works <br />department has reviewed and approved the engineer's certified cost <br />estimate and corresponding cash escrow amount. It should be noted <br />that all improvements within Windsor will be private, with the <br />exception of certain utilities facilities that will be dedicated to <br />Indian River County and will be warranted by Utility Services "Bill <br />of Sale" procedures. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners: <br />1. Grant final plat approval for the ±5.20 acre Windsor Phase IV <br />plat; and <br />2. Authorize the Chairman to execute the submitted Contract for <br />Construction of Remaining Required Improvements and accept the <br />cash escrow that secures the contract. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams,' the Board unanimously (4-0, <br />Chairman Bird being absent) granted final plat <br />approval for Windsor Phase IV, approved the Contract <br />for Construction of Remaining Required Improvements, <br />and authorized acceptance of the cash escrow <br />securing said contract, as recommended by staff. <br />CONTRACT FOR CONSTRUCTION OF REQUIRED IMPROVEMENTS <br />AND CASH DEPOSIT AND ESCROW AGREEMENT <br />ARE ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />4 <br />
