DEC 141993 BOOK 91 30 <br />Chris Guano, read aloud portions of the statement from the <br />citizens affected by the Vero Beach High Voltage Power Line as <br />follows: <br />------------------------------------------------------------------- <br />II) <br />Section 10: Limited and Heavy Utilities uses in Single -Family <br />Zoning District <br />The original language regarding New Electric Transmission lines as <br />proposed by the county planning staff and recommended unnanimously <br />by the PSAC must be included in the (Land Development Regulations) <br />LDRs changes. <br />The Board of County Commissioners directed staff more than five <br />months ago to propose' these amendments. We believe it was not <br />appropriate for the power line item to be removed from the Planning <br />and Zoning Commissions' and the Board of.County Commissioners' <br />report. The Board of County Commissioners"dlected by the public <br />and is in charge of ensuring the health, safety, and welfare of the <br />county residents. Staff should not be able to eliminate the Board <br />from this decision process by arbitrary elimination of the proposed <br />amendment against direction by the Board. <br />Exemption as to the definition of what is considered to be a <br />development in Florida Statutes 163.3164 and 380.04 is for work by <br />any utility company on an established rights-of-way and does not <br />include utility power lines within residential neighborhoods (copy <br />attached). <br />Please direct staff to include the original proposed language <br />regarding new electric transmission lines (copy attached) for your <br />consideration at the final public hearing on January 5, 1994. <br />Mr. Gunno referred to the documents he distributed and pointed <br />out items which were deleted from the original LDR in the proposed <br />amendment. He asked why these items were deleted. He compared the <br />Commissioners to parents who are obliged to make every effort to <br />safeguard our safety and welfare. <br />Planning Director Stan Boling explained that staff was <br />directed to address some of the power line issues and staff <br />determined that the only way to do so within LDRs would be through <br />the site -plan approval process. That staff recommendation was <br />presented at a PSAC meeting. After that meeting and discussions <br />with attorneys from Florida Power and Light, staff determined that <br />regulation of power lines must be handled outside the context of <br />LDRs. <br />County Attorney Charles Vitunac wished the citizens would not <br />be so "anti -County Attorney." If they do not understand the <br />reasons for the Board's action, they should call the County office <br />and find out.
