PROPOSED D.O. AMENDMENT: <br />-7 BOOK 91 PvF,978 <br />The NOPC request would amend the Village Green/Countryside D.O. to <br />effect the following three modifications: <br />1. Allow development of up to 120 single family lots and dwelling <br />units (rather than 300 mobile home units) within the portion <br />of the overall project owned by Sable Trace. Although the <br />project developer is Sable Trace, the subdivision project is <br />to be known as "Sabal Trace". <br />2. Reduce the total number of residential units allowed within <br />the overall project from 1,448 (mobile homes) to 1,283 (1,163 <br />mobile homes plus 120 single family homes). <br />3. "Update" the estimated overall project build -out date from <br />1984 to 2005. <br />Approval of the NOPC request is necessary to accommodate Sabal <br />Trace's plans to develop a portion of the overall project as a two <br />phase single family subdivision (see attachment #3). <br />CONSIDERATION OF THE REQUEST: <br />Pursuant to FS 380.06 which governs DRIB, the county may determine <br />that the request does not constitute a substantial deviation and <br />may be treated as a proposed change or "minor amendment". As a <br />minor amendment, a change in an approved D.O. can be made by the <br />Board of County Commissioners without official approval from the <br />Regional Planning Council. <br />�In accordance with LDR section 916.05(1), the Planning and Zoning <br />Commission considered the request at its December 9, 1993 meeting. <br />The Planning and Zoning Commission recommended 4-2 that the Board <br />of County Commissioners make a finding that the NOPC request does <br />not constitute a substantial deviation and that the Board approve <br />the request by adopting a D.O. resolution that incorporates the <br />,D.O. conditions recommended by staff (see attachment #4). <br />The Board is now to consider the request, and make a finding as to <br />whether or not .the request constitutes a substantial deviation and <br />approve, approve with conditions, or deny the request. <br />ANALYSIS: <br />*Determination: Not a Substantial Deviation <br />F <br />0Dnnty,:. Department of .:,Community Affairs ajDCA!`'; and Treasure Coast <br />Regional Planning Council (TCRPC) staff have reviewed the request <br />pursuant to FS 380.06 and have indicated that the requ6st does not <br />constitute a substantial deviation because the applicant has <br />demonstrated that the project will have no unacceptable level of <br />service impacts on area roadway links, that overall project density <br />will be decreased and that project impacts will likely decrease, <br />and that housing meeting building code standards will be developed <br />In lieu of mobile home housing (see attachment #5). Therefore, <br />staff concludes that the applicant has adequately rebutted any <br />presumption that the request constitutes a substantial deviation <br />and that the request may be treated as a minor amendment. Thus, <br />all staff analyses indicate that the county should find that the <br />request does not constitute a substantial deviation. <br />16 <br />_ M <br />
