JAN iSM <br />BOOK 91 pAn 551 -1 <br />Public Works Director Jim Davis advised that staff would like <br />to add a renewable clause under the term of the lease in paragraph <br />#1. <br />Commissioner Bird suggested the addition of a non -transferable <br />clause stating that the lease is strictly with the Indian River <br />Soccer Association and cannot be transferred to anyone without <br />approval by the Board of County Commissioners. <br />Commissioner Eggert understood that the way it usually works <br />is that they would have to come back to the Board if they wanted a <br />transfer. <br />Commissioner Adams agreed that we should add it anyway, and <br />Attorney Vitunac stated that he would add the non -transferable <br />clause to the lease. <br />ON MOTION by Commissioner Macht, SECONDED by <br />Commissioner Eggert, the Board unanimously approved <br />a long term, non -transferable lease for the Indian <br />River Soccer Association to use the south 25 acres <br />of the Oslo Dump site located west of Old Dixie <br />Highway south of 1st Street (20 -year renewable lease <br />at $1/year), as recommended by staff. <br />Commissioner Bird felt the lease was relatively clear that if <br />for some reason the lease is terminated by either party, the County <br />can ask for the removal of any improvements that the Soccer <br />Association has made and that the property be restored to its <br />original condition, or the County can choose to keep those <br />improvements. <br />Attorney Vitunac confirmed that the last sentence in paragraph <br />#6 sets out that condition. He explained that without a non- <br />transferable clause, the Soccer Association would have been able to <br />transfer the lease, but the transferee would have had to live up to <br />the same conditions and the same plans or it would have been a <br />breach of contract. <br />AGREEMENT WILL BE PLACED ON FILE IN THE OFFICE OF THE <br />CLERK TO THE BOARD WHEN PROPERLY EXECUTED AND RECEIVED <br />22 <br />
