BOOK 91:PArv7 Z,�.� <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously approved <br />staff's recommendation of Alternate No. 1 to grant <br />the cut and fill balance waiver based on the <br />criteria of Section 930.07(2)(d)4. <br />D. Participation in Distribution of Settlement Award Against Xerox <br />The Board reviewed the following memo dated 2/3/94: <br />TO: Board of County Commissioners <br />FROM: Terrence P. O'Brien, Assistant County Attorney�Po� <br />DATE: February 3, 1994 <br />SUBJECT: PARTICIPATION IN DISTRIBUTION OF SETTLEMENT <br />AWARD AGAINST XEROX <br />A class action law suit was filled by several categories of purchasers, <br />lessees and users of Xerox high volume copiers and printers. A <br />settlement agreement has been reached. The County as purchaser of a <br />Xerox Model 5100 is within the ambit of the class action law suit and is, <br />therefore, entitled to an award upon the proper filing of an award claim <br />form. Filing a claim form will entitle the County to a pro rata share of <br />the settlement amount based upon the County's expenditures with Xerox <br />for its high volume copier. From the information available, it is not <br />possible to calculate the amount of the award; however, inasmuch as we <br />have only one copier in the class it is unlikely that the award will be <br />substantial. <br />In view of the foregoing, it is recommended that the Chairman be <br />authorized to execute on behalf of the County the award claim form. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously authorized <br />the Chairman to execute the award claim form, as <br />recommended by staff. <br />COPY OF CLAIM FORM IS ON FILE IN THE OFFICE <br />OF THE CLERK TO THE BOARD <br />0 <br />
