F' APR - 51994 <br />mu 92. muF :38 <br />MOTION WAS MADE by Commissioner Macht, SECONDED by <br />Commissioner Bird, to adopt Ordinance 94-7, creating <br />The Moorings Street Lighting District. <br />Under discussion, Commissioner Macht asked, and Public Works <br />Director Jim Davis confirmed that the street lights will be in <br />compliance with the turtle ordinance, and no street lights will be <br />placed seaward of the dune line. <br />Commissioner Adams led discussion about the opposition of the <br />Porpoise Bay residents. <br />Director Davis responded that the 6 lights originally planned <br />for Porpoise'Bay have been eliminated. However, Porpoise Bay is <br />located at the north end of the development, and a number of street <br />lights will be located on the thoroughfare that must be traveled by <br />Porpoise Bay residents in order to reach their homes. Since <br />Porpoise Bay residents will have the benefit of those lights, staff <br />recommends including them in the assessment. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried unanimously. <br />ORDINANCE 94- 07 <br />AN ORDINANCE OF INDIAN RIVER COUNTY <br />CREATING THE MOORINGS STREET LIGHTING <br />DISTRICT. <br />WHEREAS, the residents of the Moorings have requested that the <br />County establish a mechanism for providing street lighting service at <br />crucial locations throughout the subdivision; <br />WHEREAS, the Board finds that the creation of a municipal <br />service benefit unit to raise funds through the equitable assessment of <br />property owners throughout the subdivision is the best available means <br />of accomplishing the desired goal; and <br />WHEREAS, the provision of street lighting in the area will further <br />the safety, health and well-being of all those residing and owning <br />property within the boundaries of the district, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, that: <br />14 <br />
