k <br />APR 121994 <br />NOK 92 F-,ku 191. <br />9, <br />Obligations Relating to the Use of Bond Proceeds requires the <br />County to notify FCT if any use of the islands is proposed that may <br />affect State bond proceeds used in acquiring the property, with <br />respect to legal and tax consequences. <br />Site Specific Management Plan Conditions reflect information <br />presented to FCT in the County's grant applications, relating to <br />proposed site improvements and use. Proposed improvements include <br />a limited boat dock, nature/walking trail, picnic facilities, <br />informational displays, and primitive camping. Removal of nuisance <br />exotic plants (Brazilian pepper, Australian pine) and replacement <br />with native vegetation is also a described management plan <br />condition for each project.. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners authorize <br />the Board Chairman. to execute the attached Conceptual Approval <br />Agreements, and authorize staff to contact the City of Vero Beach <br />and the Town of Indian River Shores to request their execution of <br />the agreements. Staff also recommends that the Board opt to have <br />FCT be the responsible party for all negotiation and acquisition <br />activities associated with the Prang and Lost Tree Islands <br />projects. <br />William Koolage, 11 Vista Gardens Trail, understood that the <br />subject islands were isolated and the owners could not do anything <br />with them. <br />Director Keating responded that he understood that the owners <br />must obtain a State lease over sovereignty lands to build bridges <br />to the islands, and right now there is a prohibition on the State <br />allowing leases for those type facilities. Furthermore, the City <br />of Vero Beach and the Town of Indian River Shores are involved and <br />would prohibit connection of any bridge from the mainland to those <br />islands. So, there are those constraints on development. He <br />clarified that staff's recommendation is to have Florida <br />Communities Trust (FCT) be the responsible party for all <br />negotiation and acquisition activities, but the County will have <br />the option at every stage of the process to stop the process. <br />There is no obligation on the County at this point to purchase the <br />properties. There will be costs for surveying, appraisals and <br />title work but not an appreciable amount. <br />Commissioner Macht pointed out that there is nothing to <br />prohibit development of those islands if they are accessed by <br />water, so there is capacity for development.
