Davis, P.E. <br />Public Works Directo <br />SUBJECT: Request form Robert Cairns for County to Acquire Road <br />Right -of -Way along North Property Line of Baytree <br />RE: Letter from Robert A. Cairns to Jim Davis Dated <br />March 25, 1994 <br />DATE: April 4, 1994 <br />Approximately -135 acres of land are located between Sea Oaks and Marbrisa, <br />that are currently undeveloped and have no connection to State Road AIA. <br />The owners of approximately 110 acres (81%) of this land are petitioning <br />the County to acquire a road right-of-way by special assessment funding <br />as shown on the County Thoroughfare Plan. The tight -of -way (60' in width) <br />would provide a connection for the subject property to State Road AIA, <br />thereby releasing Jungle Trail`s demand to service traffic from over 1000 <br />potential units. The County staff recognized this problem in :the mid <br />19801s, and designated certain "subdivision feeder" roads on the County <br />Thoroughfare Plan. All, costs would be assessed to the benefitted <br />property. <br />ALTERNATIVES AND ANALYSIS <br />The alternatives are as follows: <br />Alternative No. 1 <br />Approve the request and authorize staff to begin survey and <br />right-of-way negotiations. Once contracts are executed by the <br />sellers, the County can prepare special assessment resolutions <br />and conduct a public hearing to consider implementation of the <br />right-of-way acquisition. An assessment roll would be prepared <br />at that time. All costs would be assessed to benefitted owners, <br />even if eminent domain is necessary. <br />Alternative No. 2 <br />Deny the request and either require the developer to <br />independently acquire the right-of-way or approve access. onto <br />Jungle Trail when development site plans are submitted. <br />t� ylYi:A hp •int- <br />Alternative No. 1 is recommended.
