Fr ­ <br />BOCK 92 FAA. 175 <br />APR 121994 <br />On October 14, 1993, the Planning and, Zoning Commission voted 5 to <br />0 to recommend the transmittal of the proposed comprehensive plan <br />amendment request to DCA for their review. <br />On December 7, 1993, the Board of County Commissioners voted 5 to <br />0 to transmit the proposed comprehensive plan amendment request to <br />DCA for their review. <br />Consistent with state regulations, DCA reviewed the proposed <br />amendment and prepared an ORC Report, which planning staff received <br />on February 28, 1994. The ORC Report did not contain any <br />objections to the proposed amendment to the Capital Improvements <br />Element. <br />The ORC Report, however, did contain two objections to the proposed <br />amendments to the Potable Water Sub -Element and the Sanitary Sewer <br />Sub -Element. These objections, involving the prevention of urban <br />sprawl, and the preservation of agriculture and open space, relate <br />to inconsistencies between the proposed amendments and provisions <br />in the County Comprehensive Plan, state law (Rule 9J-5, F.A.C. and <br />Chapter 163-F.S.), the State Comprehensive Plan (Chapter 187 F.S.), <br />and the Comprehensive Regional Policy Plan. <br />Specifically, DCA cited the following objections: <br />1. The amendment, as proposed, is not consistent with Future Land <br />Use Element Policy 6.1 which prohibits public services which <br />would induce or encourage the development of agriculturally <br />designated areas (except to provide for the health, safety, <br />and welfare of existing residents). <br />2. The amendment, as proposed, is not consistent with Future Land <br />Use Element Policy 2.9 which states that the expansion of <br />public services shall be based on, among other things, future <br />land uses. <br />As with all proposed amendments to the county's comprehensive plan, <br />the Board of County Commissioners is now to decide whether or not <br />to adopt the proposed amendments. <br />DESCRIPTION OF THE AMENDMENTS BY ELEMENT <br />In this section, the proposed amendments to each plan element will <br />be discussed. The purpose is to identify the various portions of <br />the plan needing amendment. <br />Potable Water and Sanitary Sewer Sub -Elements <br />One component of the comprehensive plan is the Urban Service Area <br />(USA). Not only does the plan's USA limit urban development to <br />appropriate areas where urban services can be efficiently provided, <br />but the USA also delineates an area where the county will provide <br />urban services. <br />Future Land Use Element Policy 2.1 established the USA as depicted <br />on the Future Land Use Map. Because roadways are easily <br />identifiable on maps, the boundaries of the USA were established <br />along major roads. Following plan adoption, a question arose <br />regarding the economic feasibility of providing utility service to <br />only one side of roads whose rights-of-way contain utility lines. <br />Prior to plan adoption, the county had not considered this factor. <br />Subsequently, the county developed and adopted, and DCA approved; <br />Future Land Use Element Policy 1.37. <br />84 <br />I <br />
