Substantial <br />completion was issued on February 17, 1994. The Contract Agreement <br />specifies that liquidated damages in the amount of $100.00 per <br />calendar day be deducted from the monies due the Contractor for <br />each calendar day elapsing between the contract completion date and <br />the actual (substantial) completion date. The total amount of <br />liquidated damages for the 30 calendar day delay is $3,000.00. <br />ALTERNATIVES AND ANALYSIS <br />The alternatives are as follows; <br />Alternative No. 1 <br />Authorize Change Order No. 3 in the amount of (-$3,302.09) for <br />a new contract amount of $343,641.83, deduct $3,000.00 in <br />liquidated damages from the final payment for a final contract <br />amount of $340,641.83 and release final payment including the <br />10% retainage. <br />Alternative No._2 <br />Deny authorization of all or any of the items above. <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends approval of Alternative No. 1.
