April 19, 1994 <br />Indian River County Commission <br />Comments for the minute record <br />Pre -Mature - <br />RE: Reef construction: <br />Thank you for the opportunity to make comments which I desire to be <br />part of this meetings tape and the written minutes: <br />1. You are being asked to approve the commencement and I assume <br />-assurance of payment for the manufacture of components of a planned <br />reef for which you do not yet have required state permits. <br />It is also startling to hear about using a verbal --.statement <br />assuring a permit from some state person, when we have in hand a <br />letter dated April 14th. from the Director of Beaches and Shores Mr <br />Kirby Green, clearly stating, his department WILL NOT be in a <br />position to issue a permit, OR PROVIDE AN INTENT TO ISSUE A <br />PERMIT,by May 1st. because our application 'is not complete. <br />The required <br />documentation <br />has not yet been complete. <br />Complicated <br />water tank <br />tests are not.complete. <br />No one should <br />be able to <br />positively <br />guarantee a <br />permit for this device <br />which i.s <br />"experimental <br />at best", <br />no doubt, the very reason <br />for the <br />difficulty in obtaining the <br />permit. It appears that <br />political <br />pressure is <br />being exerted <br />on the state. <br />If you act today to commence construction without a permit in <br />hand, you are putting the State in a box where they may feel <br />pressured and or compelled to permit the project-. <br />As a 35 year. resident/ taxpayer of I.R. County and state <br />liscenced general contractor, I plea with you to wait for the <br />permits. I see going ahead now as very inappropriate,. <br />haphazard, and a very poor example. At yesterdays beach committee <br />meeting two attorneys raised the question about proceeding without <br />the permit. The remaining requirements before a permit is issued <br />are fairly substantial and incomplete. <br />I hear expressions of dismay toward the state for it's demanding <br />stance of --requirements for a permit. Like it or not you are under <br />jurisdiction of the state, no different that I, or any general <br />contractor i,s under your jurisdiction to }:wild anything in this <br />county. If I started a million dollar building project without a <br />permit, no matter what my time constraints ,might be, what would <br />your arm of government do to me ? Need"l ask ? Why should you <br />give a bad example. <br />My second concern is, Whenever..... before you commence this <br />"experimental project" I would like to know we have absolute <br />provision that clearly holds the reef contractor fully liable if <br />any negligence or faulty workmanship would cause the need to remove <br />the reef.
