TO: Board of County Commissioners <br />FROM: Terrence P. O'Brien, Assistant County Attorney <br />DATE: April 21, 1994 <br />SUBJECT: PROPOSED ORDINANCE ENTITLED: <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA <br />AMENDING CHAPTER 400 OF THE INDIAN RIVER COUNTY <br />CODE WITH RESPECT TO CATEGORIES OF SKILLS <br />REQUIRING _ A COMPETENCY CARD, ESTABLISHING A <br />PREREQUISITE FOR ACTIONS AGAINST A REGISTERED <br />CONTRACTOR, AND CREATING A PRESUMPTION OF <br />WORKING FOR COMPENSATION. <br />The attached ordinance has been prepared amending Chapter 400 to <br />provide for certain procedures governing the regulation of contractors. <br />A public hearing date of May 24, 1994 is suggested. <br />Commissioner Eggert led discussion regarding the categories <br />tested by Block and Associates, and that counties to the north and <br />south of us do not require the exams for every category. She asked <br />whether there has been any discussion regarding that. <br />Building Director Ester Rymer responded that our list of <br />categories corresponds with most of the counties. Brevard County <br />does not include the specialty contractors, but for the most part <br />we are all in agreement with the Block and Associates categories. <br />Commissioner Eggert reported that the question does come up, <br />and we can handle those type questions at the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanim�tzly scheduled <br />a public hearing on May 24, 1994 'to consider an <br />ordinance amending Chapter 400 of the Code with <br />respect to Categories of Skills requiring a <br />competency card, establishing a prerequisite for <br />actions against a contractor and creating a <br />presumption of working for compensation. <br />I.
