Eliminate improvements to Royal Palm Boulevard and the Royal <br />Palm Boulevard/ Indian River Boulevard intersection (condition <br />#32e.). <br />4. Eliminate improvements to the Indian River Boulevard/37th <br />Street intersection (condition #32f.). <br />5. Clarify the Indian River Boulevard/53rd Street improvements <br />(condition #32g.). <br />6. Add a new section to condition #32 to detail the required 53rd <br />Street/project driveway -intersection improvements. <br />The approved study showed that these changes are justified due to <br />roadway improvements that have been constructed or for which <br />construction has commenced since the original traffic study was <br />conducted in 1988/1989. Such improvements include the Twin Pairs <br />project and the new bridge being constructed north of the Merrill <br />Barber Bridge. <br />Pursuant to state DRI regulations, this NOPC request is now to be <br />considered by the Board of County Commissioners. In accordance <br />with county LDR regulations, the Planning and Zoning Commission <br />considered the request at its May 12, 1994 meeting. The Commission <br />voted unanimously to recommend that the Board of County <br />Commissioners find that the request does not constitute a <br />substantial deviation and that the request be approved as <br />recommended by staff at the end of this report (see attachment #5). <br />ANALYSIS: <br />•Determination of Request Type: Not a Substantial Deviation <br />Pursuant to FS 380.06 which governs DRIB, the county -may determine <br />that the request does not constitute a substantial deviation and <br />may be treated as a proposed change or "minor amendment". As a <br />minor amendment, a change in an approved D.O. can be made by the <br />Board of County Commissioners without official approval by the <br />Regional Planning Council. <br />Both the Department of Community Affairs (DCA), and the Treasure <br />Coast Regional Planning Council (TCRPC) staffs -have reviewed the <br />request pursuant to FS 380.06 and have indicated to county planning <br />staff that the request qu does not increasej ro ect <br />impacts to a <br />P <br />degree that requires substantial deviation review. lCounty staff i and the Planning and Zoning Commission agree. Therefore, in <br />staff's opinion, the NOPC request does not constitute a substantial <br />deviation and may be treated as a minor amendment. Thus, all staff <br />analyses indicate that the county should find that the. request does <br />not constitute a substantial deviation. <br />•Requested Traffic Conditions Modifications <br />This request was reviewed by county staff, and Treasure Coast <br />Regional Planning Council (TCRPC) staff, the Department of <br />Community Affairs (DCA), and the Florida Department of <br />Transportation (FDOT). None of these agencies has expressed <br />objections to approving the requested D.O. traffic condition <br />modifications. However, regional planning council staff have <br />expressed to the county some concerns about" the future level of <br />service (LOS) of the segment of US 1 between 4th Street and Oslo <br />Road (see attachment #3).
