Rea ting AICP <br />Community Developy�ent 'rector <br />FROM: Stan Boling; -AICD <br />Planning Director <br />DATE: May 31, 1994 <br />RE: Steve Courtright's Request for County <br />Allowance of Roadside Vending of Flowers <br />It is requested that the data presented herein be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of June 7, 1994. <br />DESCRIPTION & CONDITIONS: <br />Mr. Steve Courtright wishes to conduct roadside flower sales on a <br />US #1 site near 8th Street. Recently, Mr. Courtright was informed _ <br />by county planning staff that such a roadside sales operation is <br />not an allowed transient merchant use under county regulations. <br />Mr. Courtright then spoke with the County Administrator to arrange <br />to speak to the Board of County Commissioners regarding this issue. <br />Since the particular use described by Mr. Courtright is not allowed <br />in the LDRs and since the county has no authority to process or <br />grant a use variance, the Board would need to direct staff to <br />initiate an amendment to the LDRs in order to accommodate and <br />approve Mr. Courtright's request. <br />ALTERNATIVES & ANALYSIS: <br />•Existing Regulations <br />County Land Development Regulations section 972.08(4) pertains to <br />transient. merchant temporary use operations. This code section <br />specifically limits allowed transient merchants to three <br />classifications: <br />Class "A" - fruit and vegetable sales; <br />Class "B" - seasonal sales such as Christmas tree and fireworks <br />sales and other similar uses, in operation no more than 45 days <br />during any calendar year on any given site; and <br />Class "C" - satellite seafood sales (accessory to permanent retail <br />seafood sales stores located in Indian River County). <br />Moreover, subsection 972.08(4)(b) specifically exempts certain uses <br />from transient merchant regulations, those uses being: <br />16 <br />
