WAL-MART DEVELOPER'S AGREEMENT AMENDMENT <br />The Board reviewed the following memo dated May 31, 1994: <br />DATE: May 31, 1994 <br />TO: JAMES E. PIN O <br />DIRECTOR OF UT L ICES <br />PREPARED WILLIAM F. <br />AND STAFFED CAPITAL ECTS ENGINEER <br />BY: DEPAR OF UTILITY SERVICES <br />SUBJECT: WAL-MART DEVELOPER'S AGREEMENT AMENDMENT <br />INDIAN RIVER COUNTY PROJECT NO. CDC/CCS-468 <br />On January 18, 1994, the Indian River County Board of County <br />Commissioners approved a developer's agreement with Wal-Mart for <br />the construction of off-site Master Plan Utilities (see attached <br />agenda item and minutes). The installation of a master planned <br />water transmission main within Indian River Farms Water Managment <br />District's right-of-way was part of the developer's agreement with <br />Wal-Mart. As a result of permit conditions by the Indian River <br />Farms Water Management District, (ie., the clearing of the entire <br />canal right-of-way along the water main's route) we must amend our <br />agreement and increase the reimbursement to Wal-Mart. <br />ANALYSIS <br />The original approved cost in the developer's agreement was <br />$162,708.50. The construction cost of the project has been reduced <br />by $15,976.94. (See details in letter attached) However, the <br />required clearing, based on several quotes is $35,000.00. This will <br />increase the amount in the developer's agreement to $181,731.56; an <br />increase of $19,023.06. We are now in before the Board to request <br />approval of the additional monies so that the project may be <br />finaled out. <br />RECOMMENDATION <br />The staff of the Department of Utility Services recommends that the <br />Board of County Commissioners approve the expenditure of $19,023.06 <br />of additional funds as presented above. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Eggert,. the Board unanimously <br />approved expenditure of $19,023.06 of <br />additional funds as stated in the memorandum. <br />JUN 71994 33 Box 9.2a <br />
