r- -1 <br />JUy 1994 800K r ?AGE619 <br />d. Child care facilities shall provide recreation area(s) <br />and facilities that meet or exceed applicable state <br />standards. The applicant shall supply -to the planning <br />division, prior to site plan approval, written <br />acknowledgement from the state that the proposed <br />recreation area(s) and facilities meet or exceed <br />applicable state standards. The -applicant shall provide <br />either -a six-foot opaque buffer or one hundred -fifty foot <br />setback between all outdoor recreation areas -and adjacent <br />residentially designated properties. <br />e. A Type "D" buffer will be required, acceptable to the <br />planning department. <br />All of the above specific land use criteria have been <br />satisfied by this site plan application. <br />15. Concurrency: The applicant has applied for an initial <br />concurrency certificate for the project and has agreed to pay <br />all impact fees associated with obtaining the initial <br />concurrency certificate within 90 days of site plan approval. <br />The applicant has executed and filed a notarized <br />"Acknowledgement_ of. -Concurrency Requirement for Conditional <br />Site Plan Approval". .Thus, all concurrency requirements <br />associated with site plan approval have been satisfied. <br />RECOMMENDATION: <br />Based on the analysis performed, staff recommends that the Board of <br />County Commissioners grant special exception use approval for the <br />requested child care facility with the following conditions: <br />1. That no building permit shall be issued for all or any portion <br />of the project unless and until the applicant or his/her <br />successor obtain an initial/final concurrency certificate for <br />the portion of the project for which the building permit is <br />sought. <br />2. That prior to the site plan release, the applicant shall <br />revise the 8th Street driveway canal crossover design in a <br />manner acceptable to the Public Works Department._ <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. There being none, he closed the <br />public hearing. <br />ON MOTION by Commissioner Macht, SECONDED by <br />Commissioner Adams, the Board unanimously approved <br />special exception use for the 20th Avenue Church of <br />God Child Care Facility with the conditions set out <br />in staff's memorandum. <br />20 <br />
