McCoy, AICW k <br />Senior Planner, Current Development <br />DATE: June 7, 1994 <br />SUBJECT: Microvest Inc.'s request for a Right -of -Way Abandonment <br />for a Portion of the Rights -of -Way Within the Plat of <br />Homewood <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of June 14, 1994. _ <br />DESCRIPTION AND CONDITIONS: <br />Bruce Barkett, Esquire, on behalf of Microvest Inc., has submitted <br />a petition for right-of-way abandonment for portions of rights-of- <br />way within the Homewood -Plat. The Homewood plat was recorded when <br />the subject area was part of St. Lucie County. The applicant's <br />agent has stated -that, although the County may have little or no <br />legal interest in the rights-of-way, he wants the County to act on <br />the request to ensure that title of the to -be -abandoned property is <br />clear. The County Attorney's Office has confirmed that the County <br />may act on the request. ' <br />The subject rights-of-way are now within the limits of the City of <br />Fellsmere. County staff have coordinated with the City regarding <br />this request. The subject rights-of-way provide access to a number <br />of platted parcels that have been assembled under a single <br />ownership by the petitioner. The owner wants to have the rights- <br />of-way abandoned in order to replat the property, via the City's <br />development approval process, as a residential subdivision. <br />ANALYSIS: <br />Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all County divisions and utility <br />providers having jurisdiction or potential interests within the <br />right-of-way. All reviewing agencies and departments have <br />recommended approval of the abandonment. These rights-of-way are <br />not part of the roadway system as noted on the County Thoroughfare <br />Plan, and are not needed for the thoroughfare system. Furthermore, <br />abandonment would not affect access to properties abutting the <br />rights-of-way since the petitioner owns those abutting properties, <br />and those properties front other road rights-of-way_. The County <br />Attorney's Office has reviewed and approved the attached <br />abandonment resolution for legal form and sufficiency. <br />22 <br />
