AP <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to the rights - <br />of -way <br />ights- <br />of-way described in the resolution and that the Chairman of the <br />Board of County Commissioners be authorized to execute 'the attached <br />resolution. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. There being none, he closed the <br />public hearing. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Eggert, the Board unanimously adopted <br />Resolution 94-79, providing for the closing, <br />abandonment, vacation and discontinuance of a <br />portion of the rights-of-way within the plat of <br />Homewood Subdivision. <br />RESOLUTION NO. 94- 79 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING, <br />ABANDONMENT, VACATION AND DISCONTINUANCE OF A PORTION OF <br />THE RIGHTS-OF-WAY WITHIN THE PLAT OF' HOMEWOOD <br />SUBDIVISION, PLAT BOOK 2, PAGE 15 OF THE PUBLIC RECORDS <br />OF ST. LUCIE COUNTY (NOW INDIAN RIVER COUNTY), FLORIDA. <br />WHEREAS, on March 4, 1994 Indian River County received a duly <br />executed and documented petition from Bruce Barkett, Esquire, of <br />Vero Beach, ''Florida, requesting the County to close, vacate, <br />abandon, discontinue, renounce and disclaim any right, title and <br />interest of the County and the public in and to a portion of the <br />rights-of-way within the plat of Homewood Subdivision, plat book 2, <br />page 15 of the public records -of St. Lucie County (now Indian River <br />County), Florida. <br />WHEREAS, in accordance with Florida Statutes 336.10, notice of <br />a public hearing to consider said petition has been duly published; <br />and <br />WHEREAS, after consideration of the petition, supporting <br />documents, staff investigation and report, and testimony of all <br />those interested and present, the board finds that right-of-way is <br />not a state or federal highway, nor is said right-of-way necessary <br />for continuity of the County's street and thoroughfare network, nor <br />access to any given private property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. All right, title and interest of the County and the public in <br />and to that certain right-of-way being known more particularly <br />described as: <br />In Homewood, the plat of which is recorded in Plat Book <br />2, Page 15 of the Public Records of St. Lucie County, <br />Florida, that 40 foot road right-of-way lying between <br />Blocks 1937 and 1938 and South of the North line of Lot <br />13, Block 1938 extended; ALSO, that 40 foot right-of-way <br />lying between Block 1936. and 1937; ALSO, that 40 foot <br />right-of-way lying between Block 1935 and 1936; ALSO, <br />that 40 foot right-of-way lying between Block 1937 and <br />1956. <br />23 <br />JUN 141994 <br />nor 4 Fac,.692 <br />
