r M � <br />Last week, Jack MacLean, president of the Moorings Property Owners <br />Association, requested that staff ask the Board to separate the two <br />hearings and -hold them on different dates. Mr. MacLean 's position <br />is that both hearings, together, may take as long as six hours, and <br />he feels that such a long time would adversely affect both parties. <br />His suggestion is to have the hearings at separate meetings, where <br />each appeal could take up to three hours. He feels -that, with <br />separate hearings, each appeal would get more detailed <br />consideration. <br />At Mr. MacLean's request, staff contacted Halvorsen Development, <br />Inc., the site plan applicant and other party involved in the <br />appeals. It is Halvorsen's position that the appeals should not <br />be separated, but instead be heard at the July 12, 1994 meeting. <br />Based upon Planning and Zoning Commission meetings on these issues, <br />staff expects 150 to 300 people to attend the Board meeting or <br />meetings on the appeals. If the appeals are heard at the same <br />meeting, staff expects the two hearings to last between four and <br />six hours. <br />Deputy County Attorney William G. Collins II advised that <br />because the developer filed an application for appeal, the hearing <br />must be heard in a timely manner. If not, the developer could be <br />denied due process and there could be liability. The appeals <br />should be held at the same time for legal and practical reasons. <br />By law, the County must hold a public hearing within 30 days of the <br />submission of a zoning appeal. <br />It was the consensus of the Board to make no changes in the <br />scheduling of the appeals; both appeals will be heard on July 12, <br />1994 at 9:00 a.m. in the Vero Beach High School auditorium. <br />SCHEDULING OF PUBLIC HEARING TO CONSIDER ORDINANACE FOR ASSESSMENT <br />OF.$12.50 SURCHARGE ON MOVING TRAFFIC VIOLATIONS TO ASSIST IN <br />FUNDING AN INTERGOVERNMENTAL RADIO COMMUNICATIONS SYSTEM (800 MHz) <br />The Board reviewed the following memo of Emergency Services <br />Director Doug Wright dated June 10, 1994: <br />31 BOOK �� PAGE ��1 <br />
