ADMINISTRATOR <br />FRONS TERRANCE O..BI <br />DIRBCTOR OF UT SERVICES <br />SUBJECTI INDIAN RIVER FARMS HATER CONTROL DISTRICT <br />We received this draft of permit conditions from the Indian River <br />Farms Water Control District. <br />Since the District has stated that they are not responsible for any <br />damages, regardless of the cause, without limitations including <br />negligence on their part, I believe these conditions shbuld be <br />approved by you and the Board of County Commissioners. <br />Please let me know how you wish to proceed. <br />Commissioner Tippin advised that the attorney for IRFWCD <br />produced a set of conditions to be applied when the County uses <br />their right-of-way for utilities whereby we would hold them <br />blameless for any and all damages. Our attorney and Director Pinto <br />recommend approval. <br />MOTION was made by Commissioner Eggert, <br />SECONDED by Commissioner Macht, to approve the <br />right-of-way permit conditions with Indian <br />River Farms Water Control District. <br />Deputy County Attorney Collins explained the need for a <br />special contract with the Indian River Farms Water Control District <br />and advised that we will assume the risk of placing our lines in <br />their right-of-way and hold them harmless for any damage. He felt <br />we can go along with their right-of-way use permit conditions and <br />added that there are provisions for cancellation upon notice. <br />Administrator Chandler confirmed Attorney Collins' comments <br />and recommendations.
