Attorney Dill introduced Gene Winne, 2096 Windward Way, who <br />stated that he represents the consensus of the concerned residents <br />of the Moorings. He emphasized that the issue this morning is that <br />supermarkets are not listed anywhere in the Land Development <br />Regulations (LDRs) as permitted uses, while grocery stores are. He <br />believed that the Board will agree that supermarkets should not be <br />allowed in the CL District, pointing out that staff has ignored the <br />size of a supermarket when defining grocery stores. Mr. Winne <br />maintained that it would be good government to consider a <br />supermarket a special exception, consistent with Section 911.04 of <br />the LDRs. <br />Attorney Evans objected to references to the proposed site <br />plan, which is a separate appeal from the matter of supermarket vs. <br />grocery store. <br />Chairman Tippin stated that the point was well taken but that <br />we would proceed the best we can, noting that it is hard to <br />separate the two. <br />Mr. Winne continued presenting arguments against allowing a <br />supermarket on the subject site, i.e. increased hours of operation, <br />increased crime and need for more security, reduction in property <br />values, 18 -wheeler trucks unloading day and night, intensive <br />lighting, offensive odors from garbage handling, etc. He pointed <br />out that the developer does not own the subject property at the <br />present time; he only has an option to buy the property. The <br />Moorings property owners would like to buy the property from the <br />present owner. <br />Attorney Evans again objected to Mr. Winne' s references,. to the <br />site plan issue. <br />Mr. Winne concluded by emphasizing that you do not have to be <br />a lawyer or be on the County Planning staff to understand the <br />simple difference between a grocery store and a supermarket. <br />Attorney Dill referred to the following letter received from <br />The Progressive Grocer which is part of today's backup material <br />(Page 42). He understood this magazine is funded by large <br />supermarket chains, and felt the letter is self-serving and does <br />not offer an objective opinion: <br />26 92 8OC) <br />July 12, 1994 <br />
