mm 92 mrA90 <br />11. Utilities: The project will be served by water and wastewater <br />from the City b,f Vero Beach. These utility provisions have <br />been approved by the Environmental Health and Vero Beach <br />Utilities Departments. <br />12. Dedications and Improvements: <br />•External Sidewalks: The county's land development <br />regulations require that a 5' wide public sidewalk be provided <br />along Bowline Drive and Windward Way. Section <br />914.15(6)(b)2aiii allows the Public Works Director and <br />Community Development Director to waive the sidewalk <br />requirement when a physical constraint is present that would <br />preclude proper construction of a sidewalk segment. In this <br />instance, the landscape berm (considered necessary for <br />buffering). would constitute such a physical constraint. <br />Therefore, the Public Works Director and Community Development <br />Director have waived the sidewalk requirement along Bowline <br />Drive. No sidewalk then will be required along Bowline Drive. <br />•Off -Site Traffic Improvements:. The off-site traffic <br />improvements are covered in the traffic circulation element of <br />this report. <br />'I Site Lighting: The CL zoning district requires that site <br />lighting be. installed as a required improvement. The <br />applicant has proposed a site lighting plan that appears to <br />meet the requirements of the land development regulations. <br />There is a provision in section 954.07(4)(e) of the land <br />development regulations that prohibits the source of <br />illumination for site lighting from being visible from <br />adjacent properties. Staff believes that the lighting plan <br />meets this requirement, but reserves the right to require <br />field adjustment after issuance of the certificate of <br />occupancy (C.O.), to correct any lighting "spill-over" <br />problems. <br />*Signage: At staff's request, the developer has committed to <br />a monument style sign, but cannot be required to provide such <br />as sign based on the LDRs. <br />13. Environmental Issues: There are no wetlands or native upland <br />habitat on the site. The only environmental concern staff <br />initially had with the proposal was the impact of commercial <br />site lighting on sea turtles. This concern has been <br />adequately addressed by the applicant. <br />14. Concurrency: The applicant has executed a concurrency <br />acknowledgement agreement for the project, indicating that the <br />Project does not have concurrency and that an initial <br />concurrency certificate must be obtained prior to the issuance <br />of a building permit. Therefore, all concurrency related <br />requirements related to site plan approval have been <br />satisfied. <br />15.
