APPEAL CRITERIA <br />For site plan appeals to the Board, there are no specific appeal <br />criteria to be considered as there are in appeals from decisions of <br />the community development director. Therefore, this appeal is to <br />be considered by the Board in the same manner that the Planning and <br />Zoning Commission considered the-ziteplan request. The issue, <br />then, is whether or not the site plan meets all applicable county <br />LDR requirements. ' <br />In making its decision to deny the site plan, the Planning and <br />Zoning Commission failed to specify its reasons for denial. It is <br />staff's position that, with the referenced conditions, the site <br />plan meets all applicable LDR criteria and should be approved. <br />RECOMMENDATION: <br />Based -on the above analysis, staff recommends that the Board of <br />County Commissioners grant the appeal and approve the "June 28th" <br />site plan with the following conditions: <br />1. That prior to site plan release, the applicant shall obtain a <br />covenant, which is satisfactory to the County Attorney's <br />Office, that provides for removal and replacement of required <br />landscape material within the 15' utility easement, or a <br />release of 10' of the 15' utility easement. <br />2. That prior -o the issuance of a Certificate of Occupancy <br />(C.O.), all off-site traffic improvements described in section <br />6 of this report must be completed, and deemed acceptable by <br />the County Traffic Engineering Division. <br />3. That the applicant must shield all lighting in accordance with <br />section 954.07(4)(e). This could require lighting <br />adjustments and modifications after issuance of a Certificate <br />of Occupancy (C.O.). <br />4. That the developer shall install a 6' to 8' high wall the <br />length of the loading area that serves the grocery <br />store/supermarket. A portion of the wall height may be <br />reduced to provide a line of sight for trucks exiting the <br />loading area. <br />5. That the landscaping will need to be field verified to ensure <br />that all corner sight distances are maintained and that any <br />required 6' opaque vegetation feature is opaque to a height of <br />6' as measured from the project site. <br />ATTACHMENTS: <br />1.
