rox u2 tPANG4 034 <br />Administrator Chandler reported that the County has no need <br />for the property and the City Council of Vero Beach considered all' <br />the factors in terms of potential and future recreation purposes. <br />The official action taken by the City Council was that if the Board <br />were amenable, the property would be returned to the County and we <br />would amend the lease to include that parcel. He further explained <br />that the Council included a stipulation in their motion that there <br />be security fencing provided around the lake. <br />Commissioner Bird asked about the access between the present <br />and future buildings. <br />Mr. Zorc responded that there is a dry swale area between the <br />two parcels, and access between buildings would be addressed in the <br />site plan and when the project is reviewed by the Planning & Zoning <br />Commission. <br />MOTION WAS MADE by Commissioner Macht, SECONDED by <br />Commissioner Adams, to accept the conveyance of the <br />subject parcel from the City of Vero Beach and to <br />amend the 99 -year lease to St. Francis Manor <br />Apartments to include the parcel shown in the above <br />diagram. <br />Commissioner Bird led discussion regarding a reverter clause, <br />whereby the parcel would revert to the County in the event it is <br />not used by St. Francis Manor for additional apartments. Mr. Zorc <br />stated that a 5 -year reverter clause was acceptable. <br />COMMISSIONER MACHT AMENDED THE MOTION to include a <br />reverter clause. <br />Commissioner Adams asked for clarification regarding the <br />reverter clause. <br />Commissioner Bird clarified that if the parcel were not used <br />to construct additional buildings for assisted living facilities <br />within five years, the property would revert to the County. <br />Mr. Zorc confirmed that the five-year time span would be <br />satisfactory and would apply to the 79 years remaining on the <br />lease. <br />Chairman Tippin directed staff to prepare an amendment to the <br />lease and present it to the Board for approval. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried unanimously. <br />THIRD AMENDMENT AND MODIFICATION TO 99 -YEAR LEASE <br />IS ON FILE IN THE OFFICE OF CLERK TO THE BOARD <br />24 <br />July 26, 1994 <br />
