Keg ng AIC <br />Community Development rector <br />Ao <br />FROM: Stan Boling, AICP <br />Planning Director <br />DATE: August 9, 1994 <br />SUBJECT: LDR First Hearing Consideration <br />Requirements for Lot Splits <br />of Road Frontage <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its special <br />meeting of August 15, 1994, in conjunction with the other LDR <br />amendments to be considered at the same meeting. <br />DESCRIPTIONS & CONDITIONS: <br />Several months ago, Attorney Bruce Barkett appealed staff's <br />interpretation of the county's road frontage requirements. Because <br />staff's interpretation of the requirements had been applied for <br />many years and because of the importance and broad effect of <br />significant changes to the requirements, the Board of County <br />Commissioners considered and adopted an emergency ordinance on <br />April 5, 1994 to clarify beyond all doubt the county's current road <br />frontage requirements. During discussion of the emergency <br />ordinance, and at a subsequent meeting when the Board considered <br />Mr. Barkett's interpretation appeal, the Board directed staff to <br />review the road frontage requirements through the normal LDR <br />amendment process. <br />Staff has performed research on this subject, has analyzed the <br />current requirements, and has devised alternatives to the present <br />road frontage requirements. The PSAC considered this information <br />at its June 9, 1994 meeting and voted unanimously to keep the <br />existing LDR road frontage requirements as they are (as clarified <br />by the April 5, 1994 emergency ordinance), with no changes. On <br />July 14, 1994, the Planning and Zoning Commission considered this <br />matter and voted 5-0 to recommend that the Board keep the existing <br />LDR road frontage requirements as they are (see attachment #7). <br />The Board of County Commissioners is now to consider this matter <br />and determine whether to confirm the county's- existing road <br />frontage LDR requirements as reflected in the April 5, 1994 <br />emergency ordinance or to change the road frontage requirements. <br />August 15, 1994 <br />18 <br />M M <br />13 <br />
