Buildings A, B, D and F are at <br />the point of construction where tenant improvements are being made <br />and the other buildings shown are in the second phase of <br />construction. He noted that a connective building is planned <br />between Buildings D and F sometime in 1995. They anticipate a <br />completion date on the first phase sometime prior to December 1, <br />1994. <br />Attorney Evans explained that the reason for today's appeal is <br />the requirement placed upon the stores with less than 4,000 square <br />feet to provide a public toilet with direct access. Pre - <br />construction meetings were held, and this building received a <br />Certificate of Occupancy in the shell form in anticipation of <br />tenant improvements. Every space in the 4 buildings has a toilet <br />facility constructed and -in place. In addition, Buildings B and F <br />have public facilities accessible from the outside. Apparently, <br />the oversight in the toilet facilities resulted from Section 922 of <br />the Plumbing Code which states: "Every building and each <br />subdivision thereof intended for public use shall be provided with <br />public facilities in accordance with this chapter. Facilities <br />shall be directly accessible to the public through direct openings <br />or corridor areas to the areas they are intended to serve." <br />28 <br />September 6, 1994 <br />M M <br />M <br />
