Attorney Evans maintained that there are sufficient toilet <br />facilities to serve the site, but the problem is their <br />accessibility. Unfortunately., this matter was never brought up, or <br />overlooked, during the pre -construction hearings when efforts could <br />have been made to accommodate the accessibility requirements. He <br />suggested that the language included in Section 922 regarding <br />"direct accessibility" does not take into account the physiological <br />accessibility in the smaller stores when people read a sign saying <br />that they can use the toilet upon request. <br />Commissioner Eggert understood that this project is considered <br />an outside mall and the public facilities accessed from the outside <br />cannot be counted in meeting the requirements, but she wondered if <br />there is any flexibility with direct access being through a natural <br />walkway through a stockroom to the toilet at the back of a smaller <br />store if the walkway is wide enough to satisfy the Americans With <br />Disabilities Act. <br />Building Director Ester Rymer advised that 'staff felt that the <br />code was very specific and that direct access could not be through <br />a stock room.
