Concurrency: While the applicant has chosen not W apply for <br />an initial/final concurrency certificate at this time, the <br />applicant has executed and notarized a concurrency notice <br />form. The notice states that no building permit will be <br />issued for all or any portion of the project unless and until <br />an initial/final concurrency certificate is issued for the <br />project. Thus, all concurrency requirements related to site <br />plan approval have been satisfied. <br />RECOMMENDATION: <br />Based on the analysis performed, staff recommends that the Board of <br />County Commissioners grant special exception use approval for the <br />requested child care facility with the following conditions: <br />1. Prior to issuance of a certificate of occupancy, the applicant <br />shall provide proof to planning staff that the appropriate <br />State HRS license has been applied for, and that the license <br />applied for is compatible with the approved site plan. <br />2. That no building permit shall be issued for all or any portion <br />of the project unless the applicant or his/her successor <br />obtains an initial/final concurrency certificate for the <br />portion of the project for which the building permit is <br />sought. <br />Planning Director Stan Boling informed the Board that the <br />State requires the application for licensing to be handled through <br />HRS. The Planning & Zoning Commission approved the fencing for the <br />pond and playground at a height of 4 feet, with a recommendation <br />that the height be raised to 6 feet. However, the staff <br />recommendation does not include this increased height requirement. <br />Commissioner Adams questioned the limit of 15 children, and <br />Director Boling advised that this is a condition relating to HRS <br />licensing. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. <br />Mrs. Mercy Ross advised that the children would be 2 to 3 <br />years of age. The facility is restricted to care of pre-school age <br />children. <br />There being no others who wished to speak, Chairman Tippin <br />closed the Public Hearing. <br />ON MOTION by Commissioner Macht, SECONDED by <br />Commissioner Adams, the Board unanimously granted <br />special exception use approval for a child care <br />facility to Marvin and Mercy Ross, with the <br />conditions recommended by staff. <br />September 20, 1994 22 <br />
