M <br />14. - Special Land Use Criteria:' The' application must satisfy'the <br />following specific land use criteria which apply to child day <br />care facilities in the RS -6 zoning district: <br />a. The site shall be located on a paved road with sufficient <br />width to accommodate pedestrian and vehicular traffic <br />generated by the use. The facility shall be located near <br />thoroughfares, as designated in the county's major <br />thoroughfare plan, so as to discourage traffic along <br />residential streets in the immediate area. <br />b. Special passenger loading and unloading facilities shall <br />be provided on the same site for vehicles to pick up or <br />deliver clientele. Such facilities shall include <br />driveways that do not require any back-up movements by <br />vehicles to enter or exit the premises. <br />c. All regulations of the State of Florida that pertain to <br />the use as presently exists or may hereafter be amended <br />shall be satisfied. <br />d. Child care facilities shall provide recreation area(s) <br />and facilities that meet or exceed applicable state <br />standards. The applicant shall supply to the planning <br />division, prior to site plan approval, written <br />acknowledgement from the state that the proposed <br />recreation area(s) and facilities meet or exceed <br />applicable state standards. The applicant shall provide <br />either a six-foot opaque buffer or one hundred -fifty foot <br />setback between all outdoor recreation areas and adjacent <br />residentially designated properties. <br />e. A Type "D" buffer will be required, acceptable to the <br />planning department. <br />In regards to item 14.a., staff notes that the site is located <br />_near 58th_Avenue and that surrounding residents have been <br />notified about both the proposal and the Planning and Zoning <br />commission and Board of County Commissioners public hearings <br />, regording..tho.:propQsaJ,.'. "ems 14 }� ,; 14 : e. , .And*the :bu�fer�ng <br />requitement l -at the end of item 14.d=. are -adequately.addresrsod:, <br />by�the site....plan. Item 14.c. and the recreational area <br />requirements of item 14.d. can be-addressed.by condition #1 <br />recommended at the end of this report. <br />15. Fencing of the Pond Area: A small pond located to the rear of <br />the residence is currently enclosed by a 4' high chain link <br />fence. The Planning and Zoning Commission made a <br />recommendation to increase the height of the fence from 4' to <br />6'. The increased fence height was considered by the Planning <br />and Zoning Commission to be appropriate in order to ensure the <br />safety of the children that will attend the child care <br />facility. <br />It is staff's opinion that the existing 4' high fence around <br />the pond provides adequate security for children attending the <br />child care facility. This opinion is based on the fact that <br />the Standard Swimming Pool Code requirements for fenced <br />swimming pool enclosures is 4' in height. Furthermore, staff <br />notes that the HRS office which regulates child care <br />facilities has not indicated a need to increase the height of <br />the existing. .41 high fence.
