M M M <br />While allowing the land owner reasonable use of his property, the <br />proposed changes to Conservation Element Policy. 6.16 will also <br />ensure that at least 80% of C-3 designated land will be preserved. <br />In addition, these changes will ensure that, through mandatory <br />clustering of development, the impacts of any development occurring <br />in C-3 designated areas will be limited and mitigated to the <br />greatest extent possible. <br />The Data and Analysis Section of the Conservation Element <br />The proposed changes to the Data and Analysis Section of the <br />Conservation Element. are needed to ensure that this portion of the <br />plan is consistent with the proposed changes to Sanitary Sewer Sub - <br />Element Policy 6.1. <br />Consistency with the Comprehensive Plan <br />Comprehensive. plan amendment requests are reviewed for consistency <br />with .all . pol.icies ,of, •the comprehensive plan. . As per section <br />8D0:�}7:(.1-). of thii -:county code, the' s'campfeheneive �.plsn.• may., bea <br />amended only in such a way as io..pteserve the' internal.poheistencY: <br />of the plan pursuant to section 163.3177(2).F.S." � <br />The goals, objectives, and policies are the most important parts of <br />the comprehensive plan. Policies are statements in the.plan which <br />identify the actions which the county will take in order to direct <br />the community's development. Specifically, policies are the <br />courses of action or ways in which programs and activities are <br />conducted to achieve an identified goal or objective. While all <br />comprehensive plan policies are important, some have more <br />applicability than others in reviewing plan amendment requests. <br />Most important with respect to comprehensive plan amendments is <br />Future Land Use Element Policy 13.3. <br />Future Land Use Element Policy 13.3 requires that at least one of <br />three criteria be met in order to approve an amendment request. <br />These criteria are: <br />• a mistake in the approved comprehensive plan, or <br />• an oversight in the approved comprehensive plan, or <br />• a substantial change in circumstances. <br />Based on its analysis, staff feels that the proposed amendment <br />meets the second criteria of Future Land Use Element Policy 13.3. <br />Currently, the comprehensive plan contains general criteria to be <br />used to determine the location of the C-3 land use designation. <br />The comprehensive plan also contains land use criteria and <br />requirements for development within the C-3 land use designation. <br />As structured, however, existing C-3 criteria are not sufficiently <br />detailed to ensure adequate environmental protection. Since the <br />plan's lack of details regarding the exact location of and <br />requirements for development in the C-3 land use designation <br />constitutes an oversight, the second criterion of Future land Use <br />Element Policy 13.3 has been met. <br />While Policy 13.3 is particularly applicable to this request, other <br />comprehensive plan policies also have relevance. For that reason, <br />staff evaluated the. proposed amendments for consistency with all <br />policies .
