PUBLIC HEARINGS <br />PROOF OF PUBLICATION OF ADVERTISEMENT FOR HEARINGS IS ON <br />FILE IN THE OFFICE OF THE CLERK TO THE BOARD. <br />10.A.1. 18-1533 Kane Request to Rezone f 2.009 Acres from RS -1 to RS -3 & ± 4.827 Acres <br />from RS -1 to CON -2 (RZON-2017080084-80032) (Quasi -Judicial) <br />Recommended Action: Based on the analysis, staff and the Planning and Zoning Commission <br />recommend that the Board of County Commissioners approve this request to <br />rezone the subject property from RS -1 to RS -3 and CON -2 by adopting the <br />proposed ordinance. <br />Attachments: Staff Report <br />Summary Pape <br />Rezoning Application <br />Unapproved Minutes of the February 8, 2018 Planning and Zoning <br />Commission meeting <br />Rezoning Ordinance <br />Each Commissioner, as requested by the Chairman, disclosed ex parte <br />communications, site visits, or independent investigations. They also affirmed <br />that they have an open mind and can base their decisions on the evidence <br />presented and the applicable law. <br />The Deputy Clerk administered the Oath to all persons who wished to speak at <br />the hearing. <br />Community Development Director Stan Boling used a PowerPoint Presentation <br />to indicate the specific area involved in the rezoning proposal, along with <br />explaining the history and purpose of the rezoning of property. He provided <br />data indicating that there would be no adverse environmental effects as a result <br />of the proposed rezoning. Director Boling answered questions voiced by <br />Commissioner Zorc and Chairman O'Bryan. <br />Chairman O'Bryan opened the Public Hearing. <br />Scott McGuire, President, Knight, McGuire and Associates, representing Mr. <br />Eugene J. Kane, Jr., explained that the City of Vero Beach would be providing <br />water and sewer service to the proposed area. He confirmed that there are <br />riparian rights with the property, and advised that there would be no change. <br />Indian River County Florida Page 7 <br />
