BOOK PAGL 534 <br />Commissioner Adams was concerned about continued liability <br />with the retaining wall, but Director Davis didn't anticipate it <br />would be a big project to take it out. The seller was very adamant <br />about having these conditions placed on this transaction. <br />Attorney Vitunac advised that there would be continued County <br />liability if the retaining wall-- is on County property. _- <br />Commissioner Bird suggested that Director Davis restructure <br />Paragraphs B.2 and B.4 to say that the wall will be built on the <br />owner's property, not on County property. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously tabled this <br />item for two weeks until the regular meeting of <br />November 1, 1994 to allow staff to negotiate <br />further. <br />MURPHY DEED ROAD RESERVATIONS <br />The Board reviewed a Memorandum of October 6, 1994: <br />TO: James Chandler <br />County Administrator <br />THROUGH: James W. Cain, P.E. ! <br />County Engineer <br />SUBJECT: Murphy Deed Road Reservations Agreement with <br />Atlantic Coastal Title Corporation (Atlantic) <br />DATE: October 6, 1994 <br />The Board of County Commissioners at their meeting of September 27,1994, directed County Staff <br />to negotiate an agreement for services with Atlantic Coastal Title Corporation (Atlantic) the purpose <br />of which was to identify and locate Murphy Deed road reservations in Indian River County. Staff <br />has done that and believes that it has negotiated a very beneficial agreement that will provide much <br />needed information in an organized form for a reasonable price. The original proposals to staff by <br />two firms including Atlantic was more than triple the $20,000.00 figure finally negotiated. Staff was <br />able to reduce the amount by modifying the form of the requested information to reduce the time - <br />involved by using existing maps and by obtaining microfiche records of all county Murphy Deed <br />from the state. <br />OCTOBER 18, 1994 24 <br />
