Total household income under CDBG and DRI must not exceed the very low <br />income (VLI) to low -to -moderate income (LMI) limits set for the HUD Section <br />8 program at the time assistance is provided or no greater than eighty <br />percent (80%) of the Area Median Household Income (AMI) limits. <br />For regular category CDBG and DRI. The Applicant homeowner must <br />possess and provide clear title to the property, although it may be jointly <br />owned and the property may be mortgaged. Ownership through life estate, <br />heir property or other legal satisfactorily documented ownership is <br />considered satisfactory for program participation. Providing proof of title is an <br />owner responsibility and expense. <br />3. The Applicant homeowner must reside in the dwelling as a primary residence <br />to be rehabilitated for at least one (1) year prior to the time of application <br />(owner occupied assistance). In the case of the DRI category, the Applicant <br />homeowner must have been permanently residing in the dwelling unit as the <br />primary residence at the time of the declared disaster. <br />4. Property tax, mortgage payments and utility bills must be current and <br />ownership must not be jeopardized by any other threat of foreclosure, default <br />or clouded title to be eligible for CDBG and DRI owner -occupied <br />rehabilitation. <br />5. For all CDBG programs, the property must be fully insured for basic <br />hazard/homeownership insurance. Flood Insurance also applies in the one <br />hundred (100) year flood plain and the County must be named as a policy <br />holder if the home is in the one hundred (100) year flood plain. Flood <br />insurance must remain in effect for the entire period of the Deferred Payment <br />Loan Agreement. Any unit to be addressed with CDBG funds must be <br />elevated to at least one foot (1') above base flood elevation (or to local code) <br />whichever is greater, or disqualified due to cost infeasibility. This applies to <br />all categories and all activities involving construction. <br />6. For all CDBG programs, all Applicants that may have a business or familial <br />relationship with a member of the County Commission, the Citizen's Advisory <br />Task Force Committee, HRS, PA and participating construction contractors <br />must fully disclose this relationship at the time of the Application, at the point <br />in time in which the conflict occurs and definitely before a construction <br />contract is executed (see Conflicts of Interest) <br />7. For regular category CDBG and DRI, if a boundary survey is required, the <br />Applicant homeowner is responsible for providing necessary proof or <br />documentation at the homeowner's expense. <br />27 <br />
