and discuss problems in the Pine Lake Estates development. After <br />that meeting, staff researched and discussed the various issues <br />involved and coordinated with Commissioner Adams. As a result, <br />-= staff came to a consensus on an approach to address the following <br />3 basic problems: <br />1. Unbuildability of many parcels within Pine Lake Estates. <br />2. Lack of legally established road rights-of-way. <br />3. Lack of road and drainage improvements and maintenance. <br />Although concerted action by the property owners could resolve <br />these problems, staff concluded that such concerted action would <br />not be forthcoming and that the county would need to take the <br />initiative.- It was also staff's position that .the Pine Lake* <br />Estates property owners, rather than the general public, should <br />bear the costs involved in resolving these problems, since the <br />property owners would directly benefit from such actions. <br />*Board Action: Fall 1993 <br />At the September 21, 1993 Board of County Commissioners meeting, <br />staff recommended that the Board initiate general actions to help <br />address the 3. problems identified. above. Prior to that meeting, <br />staff mailed a copy of its report and recommendation to all Pine <br />Lake Estates property owners listed on the tax rolls. Many Pine <br />Lake Estates property owners attended the meetings and several <br />participated in the discussion. At the conclusion of the meeting, <br />the Board stated that it agreed with staff's recommendations and <br />authorized staff to: <br />1. Conduct surveying work necessary to provide a legal <br />description for road rights-of-way running through Pine Lake <br />Estates. Owners of Pine La4ke Estates parcels are to be <br />assessed for the surveying costs on a per "lot" basis <br />(estimated cost per "lot" not to exceed $48.08). <br />2. Draft a resolution (which includes the rights-of-way legal <br />description) for the Board Chairman to sign that would legally <br />establish road rights-of-way in Pine Lake Estates. <br />Note: The Board agreed that the rights-of-way would be <br />accepted by the county for regulation purposes but would not <br />be accepted for maintenance purposes. Private property <br />owners, individually or as a group, would be responsible for <br />maintenance and would be allowed to propose road and drainage <br />improvements within the rights-of-way via applications to <br />county engineering for county right-of-way permits. <br />3. Initiate an application for subdivision variances to be <br />granted for Pine Lake Estates to allow the buildability of <br />parcels of record. <br />Relevant minutes from the September 21, 1993 meeting are contained <br />in attachment #3 of this report. <br />Board Action Needed Now <br />Since the September 21, 1993 meeting, staff has had the road <br />rights-of-way surveying work performed and checked (at a cost <br />significantly lower than the original estimate), has drafted a - <br />resolution for the county to accept and establish the rights-of- <br />way, and has initiated the subdivision variance process.
