Establishina & Accentinc Road Rights-o€-Wa <br />A resolution for Board approval is attached accepting the <br />dedication of rights-of-way within Pine Lake Estates. The sketched <br />rights-of-way are described by metes and bounds. No maintenance <br />responsibility is accepted by Indian River County until -such time <br />as the Board of County Commissioners accepts maintenance <br />responsibility by separate resolution. Staff's position is that <br />any future acceptance of maintenance be made only if the roads are <br />brought up to county standards (paved). These items are addressed <br />in the attached resolution (see attachment #6). <br />Assessing Costs of Surveying Work <br />The Public Works Department has prepared an agenda item for today's <br />meeting that the Board will consider next on its meeting agenda. <br />That agenda item addresses the special assessment process for <br />recouping the costs of the previously referenced survey work. <br />Actions required by the Board to initiate the assessment process <br />are discussed and recommended in that agenda item. <br />RECOMENDATiON: <br />Staff recommends that the Board of County Commissioners: <br />1. Grant the requested subdivision variances. <br />2. Adopt and have recorded the attached resolution establishing <br />and accepting road rights-of-way for legal access, county <br />control, and private maintenance and improvement. <br />Director Boling stressed that adoption of the resolution would <br />establish the rights-of-way where the County would accept the <br />rights-of-way with no obligation for maintenance. <br />Director Boling explained that he would discuss the background <br />of the subdivision and the resolutions establishing the road <br />rights-of-way and -County Engineer Roger Cain would discuss the <br />action needed for the assessment for the survey work. <br />Commissioner Bird asked the anticipated cost to the residents, <br />and. Director Boling responded that the only cost would be for the <br />survey work, -and any future improvements would be done by a <br />separate assessment. <br />Mr. Cain explained that there is a companion item regarding <br />resolutions to provide for the survey work and to set the public <br />hearing date for interested persons to be heard as to the cost of <br />the survey work. The public hearing is part of the procedure <br />followed on assessments to property owners. The average cost to <br />property owners is $21.96, with some as high as $131.78 for parcels <br />which were combined. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. <br />October 25, 1994 <br />22 <br />M <br />M <br />
