B. to perform and
<br />complete the Work in accordance with the Contract
<br />Documents shall be absolute. None of the following
<br />will constitute on acceptance of Work that in not in
<br />accordance with the Contract Documents orarelease
<br />ofCONTFACTOR'mobligation boperform the Work in
<br />accordance with the Contract Documents:
<br />observations bvENGINEER;
<br />2. recommendation by ENGINEER or
<br />payment by OWNER of any progress or final
<br />payment;
<br />3. the issuance of nortifiooba cfSub-
<br />stantial Completion NG|NEER or any
<br />payment related thereto bvOWNER;
<br />4. use oroccupancy of the Work many
<br />part thereof by OWNER;
<br />5. any acceptance by OWNER or any
<br />failure todono�

<br />8. any navkam and approval of o Shop
<br />Drawing orSample submittal orthe issuance of
<br />anotice nfacceptability hmENGINEER;
<br />7. any inspection, hast or approval by
<br />Pthemu'. or
<br />0. any correction of defective VVodv by
<br />OWNER.
<br />6.20 Indemnification
<br />A. To the fullest extent bvLaws and
<br />Regulations, CONTRACTOR shall indemnify and hold
<br />harmless OWNER, ENGINEER, ENG|NEER's
<br />Conou|bynts, and the offimsna, directors, pahnera,
<br />emp|oyeas, agento, and other consultants and
<br />subcontractors of each and any of them from and
<br />against all c|oirna. costs, |ooaea, and damages
<br />(including but not limited toall fees and charges nf
<br />engineers, archibacts, atbomne/a, and other
<br />professionals and all court or arbitration or other
<br />dispute resolution costs) ohs|n0 out of or relating to
<br />the performance of the VVod«, provided that any such
<br />claim, cost, loss, or damage:
<br />1. is attributable to bodily '
<br />sickness, disease, ordeath, orto'injury to or
<br />destruction of tangible property (other than the
<br />\8kodk dzeUl. including the loss of use resulting
<br />therefrom; and
<br />2. is caused in whole or in part by any
<br />negligent act or omission of CONTRACTOR,
<br />any Subcontractor, any Suppxer, or any
<br />individual or emUb/ directly or indirectly
<br />employed bvany ofthem boperform any ofthe
<br />Work or anyone for whose acts any of them
<br />may be |iab|a, nsgond|e$o of whether or not
<br />caused inpart bvany negligence or omission of
<br />anindividual orentity indemnified hereunder or
<br />whether liability |simposed upon such indemni-
<br />fied party bvLaws and Regulations nagard|aao
<br />of the negligence of any such individual or
<br />entity.
<br />B. In any and all claims against OWNER or
<br />ENGINEER or any of their respective consuKants,
<br />agents, officers, dinecbors, partners, or employees by
<br />any employee (or the survivor or personal
<br />representative of such employee) of CONTRACTOR,
<br />any Subcontractor, any Supplier, orany individual or
<br />entity directly or indirectly employed by any of them to
<br />merfomn any ofthe Work, oranyone for whose acts
<br />any of them may be |iob|e, the indemnification
<br />obligation under paragraph 6.20.A shall not be limited
<br />in any way by any limitation on the amount ortype of
<br />damages,ati n. or benefits payable by or for
<br />CONTRACTOR or any such Subcontractor, Supplier,
<br />or other individual or entity under workers' compen-
<br />sation mc±a, disability benefit acts, orother employee
<br />benefit acts.
<br />C. The indemnification obligations of CON-
<br />TRACTOR under
<br />ON-TRACTORundmr paragraphG20'Ashall not extend bo
<br />the liability of ENGINEER and ENG|NEER'a
<br />Consultants or to the offioera, dinecbona, padnano,
<br />ernphnxyes, agente, and other consultants and
<br />subcontractors ofeach and any ofthem arising out of.
<br />1. the preparation or approval of, orthe
<br />failure to prepare or approve, maps, Ooawingn,
<br />opiniono, reports, munxayo. Change C)rdena,
<br />designs, orSpecifications; or
<br />� ' d��u�or��u�o� or
<br />failing togive them, ifthat iathe primary cause
<br />of the injury or damage.
<br />ARTICLE 7 - OTHER WORK
<br />7.01 Related Work edSite
<br />A. OWNER may perform other work related to
<br />the Project at the Site by OWNER's employees, or let
<br />other direct contracts therefor, or have other work
