Acceptance of Vero Beach Deed of Easement for Utility System for Vero <br />Highlands <br />The Board reviewed memo from County Attorney Charles Vitunac <br />dated October 24, 1994: <br />TO: Board of County Commissioners <br />FROM: Charles P. Vitu , County A orney <br />DATE: October 24, 1994 <br />RE: Acceptance of Vero Beach Deed of Easement for <br />Utility System for Vero Highlands <br />The Department of Utility Services has requested that the City of Vero <br />Beach give an easement to the County for use of one of the City's <br />electrical easements as part of the County utility system, and the City <br />has agreed to do so subject :to certain conditions. The conditions are <br />that the County remove its utility systems if required and pay $1200.00 <br />per year per mile beginning 1/5/95 for the use of the right of way. <br />Requested Action: Staff recommends County acceptance of the City <br />easement and authorization for the Chairman to execute same. <br />Assistant County Attorney Terry O'Brien recounted that in <br />February of 1992 the City -of Vero Beach asked for and received an <br />easement for power lines over County property. Then Commissioner <br />- Scurlock made a motion to charge the City $1,500 per year for the <br />easement, and_the Board passed that motion. Prior to that the <br />County and the City would grant easements to each other with no <br />conditions. Recently the Department of Utility Services requested <br />an easement and the City agreed to grant that easement subject to <br />a payment of $1,200 per year. Attorney O'Brien reported that he <br />and Assistant Director of Utilities Services Harry Asher approached <br />the City to see if they would accede to reverting to the old <br />procedure. Vero Beach City Manager Tom Nason explained that the <br />only reason the City required the $1,200 fee is because of the <br />County's $1,500 fee. Attorney O'Brien suggested that the Board <br />reform the easement of 1992 to remove the fee. The City will then <br />remove their fee from this easement, and it will promote <br />intergovernmental harmony and remove some bookkeeping. <br />FAU <br />15 BOOK 664 <br />November 1, 1994 <br />
