Commissioner Bird questioned having this item on the agenda <br />because the Board discussed this item several months ago-, approved <br />a transportation study and decided to defer making a decision until - <br />the transportation study was complete. <br />Attorney O'Brien explained that this item was placed on the <br />agenda at the prompting of Mr. -Cairns and because the County <br />Attorney's office is concerned about Mr. Cairns instituting legal <br />action against the County. <br />Commissioner Eggert expected this item to be discussed at the <br />next Metropolitan Planning Organization (MPO) meeting, and she <br />preferred to table the decision until after the MPO meeting. <br />Commissioner Bird preferred to table it until we get the <br />transportation study report. <br />Director Keating advised that this item was scheduled for the <br />November MPO agenda, but because of circumstances it had to be <br />deferred to the December meeting. <br />Commissioner Eggert noted that if the MPO decides the road <br />should be constructed, that would resolve the matter. If MPO <br />decides that it should not be constructed, the Board can take up <br />the discussion before the end of the year. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously tabled this <br />matter until the Board meeting following the <br />December MPO meeting. <br />REAM COURT ACTION REGARDING ACTING CIRCUIT <br />Attorney Vitunac recounted that the Board directed him to <br />_- contact the other counties in the district and the Florida <br />Association of* Counties (FACo) regarding the appeal filed by L. B. <br />(Buck) Vocelle, Jr., concerning Chief Judge Vocelle's assignment of <br />County Judges to hear felony cases. He reported that the General <br />Counsel for FACo, Bill Roberts, agreed that this was not a county <br />issue. Mr. Roberts was aware of the circumstances and felt this <br />was a State Court matter. Attorney Vitunac's Legal Assistant Lea <br />Keller contacted the offices of the county attorneys in the other <br />three counties in our circuit and none of them really knew about <br />it, were too busy and did not have a budget to participate in any <br />action. Attorney Vitunac repeated advice from a local judge that <br />the County Commission should stay out of it. The recommendation <br />from everyone is that it is not a County matter and that the Board <br />not participate.
