has been submitted by the applicant. The county engineering <br />division has approved the letter of credit amount as being adequate <br />to cover the cost of the remaining required improvements. The <br />county attorney's office has approved the contract for -legal form <br />and -.sufficiency and has approved the format of the letter of <br />credit. <br />All applicable requirements regarding final plat approval have been <br />satisfied. Pursuant to the county's LDRs, the applicant will be <br />required to obtain a certificate of completion after completion of <br />the required improvements. At that time, the applicant will <br />warranty the utilities which will be the only publicly dedicated <br />subdivision improvement. <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends that the Board of <br />County Commissioners grant final plat approval for Oak Point <br />Subdivision, authorize the chairman to sign the contract for <br />construction, and accept the letter of credit. <br />Director Keating advised that one change is needed on this <br />plat in that the 5 foot limited access easement will become both a <br />5 foot limited access and pedestrian easement. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Eggert, the Board unanimously granted <br />final plat approval for Oak Point Subdivision, as <br />amended to.indicate that the 5 foot limited access <br />easement become a 5 foot limited access and <br />pedestrian easement, and authorized the Chairman to <br />execute. the Contract for Construction of Required <br />Improvements with Oak Point Corporation, pursuant to <br />recommendation of staff. <br />CONTRACT IS ON FILE IN THE <br />OFFICE OF THE CLERK TO THE BOARD <br />9 <br />November 8, 1994 <br />BOOK W PALL 737 <br />
