Attachment A — SCOPE OF WORK <br />Project Name: <br />Indian River County <br />FWC Agreement No. <br />18101 <br />Artificial Reef Construction 2018-19 <br />2. The Consultants Competitive Negotiation Act (Section 287.055, F.S.) is not applicable for <br />professional services pertaining to artificial reef planning, procurement, deployment or <br />survey activities during this Agreement. Signed and sealed drawings are not required. <br />In accordance with Executive Order 12549, Debarment and Suspension, the GRANTEE <br />shall agree and certify that neither it, nor its principals, is presently debarred, suspended, <br />proposed for debarment, declared ineligible, or voluntarily excluded from participation in <br />this transaction by any Federal department or agency; and, that the GRANTEE shall not <br />knowingly enter into any lower tier agreement, or other covered transaction, with a person <br />who is similarly debarred or suspended from participating in this covered transaction, <br />unless authorized in writing to the COMMISSION by the federal agency issuing the grant <br />award. Upon execution of subcontracts funded by this Agreement, the GRANTEE shall <br />require subcontractors to complete, sign and return a copy of the form entitled <br />"Certification Regarding Debarments, Suspension, Ineligibility and Voluntary <br />Exclusion - Lower Tier Federally Funded Transactions", attached hereto and made a part <br />hereof as Attachment E. As required by sentences 1 and 2 above, the GRANTEE shall <br />include the language of this section, and Attachment E in all subcontracts or lower tier <br />agreements executed to support the GRANTEE's work under this Agreement. <br />C. FEDERAL FUNDS <br />This Agreement is funded in whole or in part by a grant from the U.S. Fish and Wildlife <br />Service, Federal Aid in Sport Fish Restoration Program, CFDA No. 15.605. Therefore, the <br />GRANTEE shall be - responsible for complying with all federal grant requirements as <br />provided in the grant, a copy of which is attached hereto and made a part hereof as <br />Attachment C. It is understood and agreed that the GRANTEE is not authorized to expend <br />any federal funds under this Agreement to a federal agency or employee without the prior <br />written approval of the U.S. Fish and Wildlife Service. <br />2. The Davis -Bacon Act is not applicable to subcontracts executed under this Agreement. <br />This project is funded by the Dingell -Johnson Sport Fish Restoration Act which does not <br />require implementation of the provision of the Davis -Bacon Act as the initial federal award <br />to the COMMISSION was exempt from the Davis -Bacon Act conditions. <br />3. The GRANTEE agrees to follow all requirements of CFR 200, Code of Federal <br />Regulations, for the procurement of commodities or contractual services under this <br />Agreement. <br />4. The GRANTEE shall be required to provide a minimum matching contribution of <br />$9,750.00 of the total project costs in support of the COMMISSION's grant from the U.S. <br />Fish and Wildlife Service. <br />5. The COMMISSION shall make payment to the GRANTEE for an amount of the total <br />project eligible cost less the $9,750.00 match, not to exceed $55,250.00 of approved <br />invoiced costs. The $9,750.00 of invoice costs not reimbursed by the COMMISSION shall <br />represent the GRANTEE's matching contribution as required by the COMMISSION's <br />grant from the U.S. Fish and Wildlife Service. <br />Version 1.0 — June 2013 Attachment A, Page 11 of 12 <br />
