Board of County Commissioners Meeting Minutes-Final December 11,2018 <br /> Community.Development Director Stan Boling recalled that at the November _ .. <br /> 13,2018 meeting,the Board heard a request by.Ms. Kim Gilbert,representing <br /> Kiducation, Inc. dba Oxford Academy, located on 24th Street in the City of <br /> • Vero Beach:(City),.that the impact fees not paid by the previous owner be <br /> waived. He:concluded that staff..was directed to perform more research on the <br /> matter and report back:to the Board. - <br /> Director Boling added that the impact fees were due when the previousowner <br /> converted the.buildingfrom.an adult living facility to a.childcare facility;the <br /> previous owner had gone through part of the City's approval process,but failed <br /> to obtain building permits and:pay the impact fees: He noted that it was not <br /> discovered until Ms. Gilbert:tried to obtain a permit for a deck expansion. He <br /> added that the amount of impact fees due was approximately$7,000 and could <br /> not be waived. It was staff's recommendation that.the Board:find special <br /> circumstances and direct staff to prepare an impact fee payment deferral <br /> agreement to delay the.impact fees until a change in ownership of the childcare <br /> facility. <br /> County Attorney-Dylan Reingold suggestedthat the agreement be recorded in <br /> : : . the:public records. <br /> Kim Gilbert, Owner of Oxford Academy, 1728 and 1730 24th Street, spoke on <br /> her request for the impact fees to be waived. <br /> The following speakers offered their opinions regarding the matter: <br /> Joseph:Paladin,Black Swan Consulting <br /> Edward Dillard, 935 24th Place_SW <br /> A discussion ensued among the Board confirming there would be no interest or <br /> late:charges added on, and:that there would bean option for the current owner <br /> to makep <br /> l p..artiaaYm .ents over time. <br /> . <br /> A motion was made by Commissioner Flescher,seconded by Commissioner <br /> O'Bryan,to approve the deferral of the impact fees in the amount of$7,930.78 <br /> until there:is a change in ownership and for the Impact Fee Deferral Agreement to <br /> be recorded: The motion carried by the following vote: <br /> Aye: 4- Chairman Solari,Vice Chairman Adams, Commissioner Flescher, and <br /> Commissioner O'Bryan <br /> Nay: 1 - Commissioner Zorc <br /> The Chairman called a recess at 10:23 am., and reconvened the meeting at 10:32 <br /> a.m.; with all members present. <br /> Indian River County Florida Page 7 <br />
