WHEREAS, the City Council of the City of Fellsmere in Indian River County <br />on Tuesday. September 12. 1995 at 7:00 P.M. conducted the public hearing at <br />Fellsmere Elementary School, with regard to the special assessments, <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF FELLSMERE IN INDIAN RIVER COUNTY, FLORIDA, as <br />follows: <br />I. The foregoing recitals are affirmed and ratified in their entirety. <br />2. The special assessments shown on the attached assessment roll are <br />hereby confirmed and approved, and shall remain legal, valid, and binding first liens <br />against the properties assessed until paid in full. <br />3. The County will record the special assessments and this resolution, which <br />describes the properties assessed and the amounts of the special assessments, on the <br />public records, which shall constitute prima facie evidence of the validity of the <br />special assessments. <br />4. Those property owners whose assessment is $2,000.00 or more shall be <br />allowed to pay the assessment over a period of four (4) years at an interest rate of <br />8 1/2% per annum. All property owners whose assessment is less than $2,000.00 <br />shall pay the assessment over a period of two (2) years, at an interest rate of 8 1/2% <br />per annum. If the entire assessment is paid in full within 90 days after receiving <br />the initial assessment bill there shall be no interest due. <br />
