CAPITAL IMPROVEMENTS ELEMENT <br />Availability of Capacity <br />Facility capacity can -be assessed two different ways. First, <br />facility capacity can be determined by facilities that are existing <br />and available; examples would be existing treatment plants and <br />existing roadways with a set number of lanes. The second manner <br />for assessing facility capacity is to consider both existing, in - <br />the -ground facilities as well as facility expansions or new <br />facilities which are programmed but not yet existing. <br />For purposes of assessing facility capacity, the capacity of <br />existing, in -the -ground facilities will be considered in all cases. <br />Programmed facilities will be considered in assessing capacity for <br />each public facility category when the following conditions are <br />met: <br />o For sanitary sewer, potable water, solid waste and drainage <br />facilities: <br />- a development order or permit is issued subject to <br />the condition that, at the time of the issuance of <br />a certificate of occupancy, the necessary <br />facilities and services are in place and available <br />-----facility-expansion-is-a-condition-of-a-development <br />order°; or <br />- facility is currently under construction; or <br />- facility is guaranteed by an enforceable <br />development agreement. <br />o For recreation facilities: <br />facility expansion is the subject of a binding <br />executed contract providing for commencement of <br />construction or property acquisition within one <br />year of development -order issuance of a certificate <br />of occupancy; or <br />facility expansion or property acquisition is <br />guaranteed in an enforceable development agreement <br />providing for facility expansion/property <br />acquisition within one year of development --order <br />issuance of a certificate of occupancy. <br />o For transportation facilities: <br />-----faei}ftp--expansion--meets--any--of--the--criteria <br />referenced -above; -or <br />- -- - - f ac i } i tp-expansion -must-be--i-nc i-uded- Air- the -c onntyl a <br />Fine-year-Schedule-of-eapita}-improvements;-and <br />e----the-facility-must-b% -i-nciJttded-witt! rthe-urban <br />service -area; <br />® ---- the-facillty-must -have -errr-estimated-date -for <br />construction -to -begin -and -be -completed; <br />e----the--facility--must--be--scheduled--to--start <br />construction- by- t+te--third -yew-of-the-5-Fear <br />Schedule-cf-eapital-improvements;-and <br />a - - - -a- delay--i-rr -c:onstruetri�rr -off--the -facif itp -r+i } } <br />require -e -comprehensive -plan -amendment; <br />e - - - - the -capital -improvements- -e-lement- imd- the -Five - <br />Fear-Schedule-cf-eapitai-Improvements-mast-be <br />financially -feasible; <br />e ---- the-Five-Year-Schedtrl% -&f-eapi.ta-l-Improvements <br />must -- itrai-ntrai-n- - -adapted - - -level- - -orf- - -service <br />standards; - -must - -serve- - -new- - development --end <br />
