Statutes 218.70. The invoice shall be consistent with the payment schedule established in 5.1 and any additional amount for services rendered pursuant to 5.3. 5.3 Additional Services: If additional services are requested by the COUNTY or required, then the cost of these additional services shall be based on the hourly rates identified in Exhibit B of this CONTRACT and shall only be performed if a work order or CONTRACT amendment is executed by both COUNTY and CONSULTANT. 5.4 Social Security: The County shall not be liable for Social Security contributions or federal withholding of income tax relative to the compensation of CONSULTANT staff. 6. STATUTORY DISCLOSURES 6.1 Solicitation of Contract: The CONSULTANT warrants that it has not employed or retained any company or person, other than a bonafide employee working solely for CONSULTANT to solicit or secure this CONTRACT and that it has not paid or agreed to pay any person, company, corporation, individual or firm, other than a bonafide employee working solely for CONSULTANT, any fee, commission, percentage, gift, or other compensation contingent upon or resulting from the award or making of this CONTRACT. 6.2 Public Entity Crime Affidavit: As provided by Florida Statute 287.133(2)(a), a person or affiliate who has been placed on the convicted vendor list following a conviction for a public entity crime may not submit a bid on a contract to provide any goods or services to a public entity, may not submit a bid on a contract with a public entity for the construction or repair of a public building or a public work, may not submit bids on leases of real property to a public entity, may not be awarded or perform work as a contractor, supplier, subcontractor, or consultant under a contract with any public entity, and may not transact business with any public entity in excess of the threshold amount provided in Florida Statute 287.017 for Category Two for a period of 36 months from the date of being placed on the convicted vendor list. Any person must notify the County within 30 days after a conviction of a public entity crime applicable to that person or to an affiliate of that person. By its execution hereof, CONSULTANT certifies that neither it nor an affiliate is on the convicted vendor list. 7. INSURANCE AND INDEMNIFICATION 7.1 The CONSULTANT shall not commence work on this CONTRACT until it has obtained all insurance required under this CONTRACT as may be modified and approved by the County's Risk Manager. 7.2 CONSULTANT shall procure and maintain, for the duration of this CONTRACT, the minimum insurance coverage as set forth herein. The cost of such insurance shall be included in the CONSULTANT's fee: 7.2.1 Workers' Compensation: Workers' Compensation as required by the State of Florida Employers' Liability of $100,000 each accident, $500,000 disease policy limit, and $100,000 disease each employee. 7.2.2 General Liability: commercial general liability coverage, including contractual liability and independent contractor, with a minimum combined single limit of $500,000 per occurrence. The listed breakdown of required General Liability insurance coverages included in the RFP (e.g. Each Occurrence, Fire Damage -any one fire, Medical Expenses -any one person, etc.) shall not apply to this CONTRACT. 6
