Statutes 218.70. The invoice shall be consistent with the payment schedule established in 5.1 <br />and any additional amount for services rendered pursuant to 5.3. <br />5.3 Additional Services: If additional services are requested by the COUNTY or required, <br />then the cost of these additional services shall be based on the hourly rates identified in Exhibit <br />B of this CONTRACT and shall only be performed if a work order or CONTRACT amendment <br />is executed by both COUNTY and CONSULTANT. <br />5.4 Social Security: The County shall not be liable for Social Security contributions or federal <br />withholding of income tax relative to the compensation of CONSULTANT staff. <br />6. STATUTORY DISCLOSURES <br />6.1 Solicitation of Contract: The CONSULTANT warrants that it has not employed or <br />retained any company or person, other than a bonafide employee working solely for <br />CONSULTANT to solicit or secure this CONTRACT and that it has not paid or agreed to pay <br />any person, company, corporation, individual or firm, other than a bonafide employee working <br />solely for CONSULTANT, any fee, commission, percentage, gift, or other compensation <br />contingent upon or resulting from the award or making of this CONTRACT. <br />6.2 Public Entity Crime Affidavit: As provided by Florida Statute 287.133(2)(a), a person or <br />affiliate who has been placed on the convicted vendor list following a conviction for a public <br />entity crime may not submit a bid on a contract to provide any goods or services to a public <br />entity, may not submit a bid on a contract with a public entity for the construction or repair of a <br />public building or a public work, may not submit bids on leases of real property to a public entity, <br />may not be awarded or perform work as a contractor, supplier, subcontractor, or consultant <br />under a contract with any public entity, and may not transact business with any public entity in <br />excess of the threshold amount provided in Florida Statute 287.017 for Category Two for a <br />period of 36 months from the date of being placed on the convicted vendor list. Any person <br />must notify the County within 30 days after a conviction of a public entity crime applicable to that <br />person or to an affiliate of that person. By its execution hereof, CONSULTANT certifies that <br />neither it nor an affiliate is on the convicted vendor list. <br />7. INSURANCE AND INDEMNIFICATION <br />7.1 The CONSULTANT shall not commence work on this CONTRACT until it has <br />obtained all insurance required under this CONTRACT as may be modified and approved by <br />the County's Risk Manager. <br />7.2 CONSULTANT shall procure and maintain, for the duration of this CONTRACT, the <br />minimum insurance coverage as set forth herein. The cost of such insurance shall be <br />included in the CONSULTANT's fee: <br />7.2.1 Workers' Compensation: Workers' Compensation as required by the State of <br />Florida Employers' Liability of $100,000 each accident, $500,000 disease policy limit, and <br />$100,000 disease each employee. <br />7.2.2 General Liability: commercial general liability coverage, including contractual <br />liability and independent contractor, with a minimum combined single limit of $500,000 per <br />occurrence. The listed breakdown of required General Liability insurance coverages included <br />in the RFP (e.g. Each Occurrence, Fire Damage -any one fire, Medical Expenses -any one <br />person, etc.) shall not apply to this CONTRACT. <br />6 <br />
