Board of County Commissioners <br />Meeting Minutes - Final January 8, 2019 <br />Chairman Solari disclosed his ownership of ERU shares, and that the County <br />Attorney had ruled this did not provide a conflict of interest. <br />The Board sought and received answers from Director Burke regarding the <br />number of accounts that were in arrears and the value of those unpaid service <br />charges. Director Burke went on to explain the burden of reserving capacity, <br />and the importance of reclaiming ERUs from the unpaid accounts. <br />After further discussion, the Board agreed upon a deadline date of July 8, 2019 <br />for the release from overdue service availability charges. <br />A motion was made by Commissioner O'Bryan, seconded by Commissioner <br />Flescher, to adopt Ordinance 2019-002, amending Section 201.08 (Rates and <br />Charges) and Section 201.09 (Impact Fees) of Part I (in General) of Chapter 201 <br />(County Water and Sewer Services) of the code of Indian River County, Florida in <br />order to allow for reclaiming and relinquishment of water and sewer impact fees <br />under certain circumstances; modified to include the deadline date of July 8, <br />2019; and providing for codification, severability, repeal of conflicting provisions, <br />and an effective date. The motion carried by the following vote: <br />Aye: 5 - Chairman Solari, Vice Chairman Adams, Commissioner Flescher, Commissioner <br />O'Bryan, and Commissioner Zorc <br />B.
