Board of County Commissioners <br />Meeting Minutes - Final January 8, 2019 <br />10.A.2. 18-2651 <br />reasons Indian River County became a biosolids land application site, and why <br />the County is prevented from enacting a permanent solution. <br />There being no other speakers, the Chairman closed the Public Hearing. <br />The Board expanded on their appreciation for the cooperation received from <br />landowners and provided an update on the legislative activity related to the <br />biosolids issue. <br />A motion was made by Commissioner Flescher, seconded by Commissioner <br />O'Bryan, to adopt Ordinance 2019-001, authorizing an extension of the temporary <br />moratorium for an additional 180 days, or until a comprehensive review of the <br />impact on the County's ecosystem is completed, within the unincorporated areas <br />of Indian River County prohibiting land application activities of Class B biosolids; <br />providing for additional study and possible regulation of Class B biosolids <br />application activities; providing for exhaustion of administrative remedies; and <br />providing for severability, repeal of conflicting provisions, and an effective date. <br />The motion carried by the following vote: <br />Aye: 5 - Chairman Solari, Vice Chairman Adams, Commissioner Flescher, Commissioner <br />O'Bryan, and Commissioner Zorc <br />Reclamation and Relinquishment of ERUs and Release of Service Availability <br />Charges for ERUs Reserved for Future Use (Settlement of Delinquent Reserve <br />Accounts) (Legislative) <br />Recommended Action: Staff recommends that the Chairman open the public hearing, take comments <br />from the public and then close the public hearing, and that the Indian River <br />County Board of County Commissioners vote to adopt the ordinance <br />Attachments: Staff Report <br />Draft Ordinance 2019 - <br />Vincent Burke, Director of Utility Services, provided details of the proposed <br />Ordinance which modifies the process for reclaiming and relinquishment of <br />equivalent residential units (ERUs) reserved for future use. <br />The Board entered into a discussion regarding the procedures for implementing <br />the revised policy and whether those procedures should be spelled out in the <br />Ordinance. Director Burke shared that a letter had been sent to ERU holders <br />advising them of the planned changes. <br />Commissioner O'Bryan brought forth a concern that had been raised regarding <br />the release of service charges policy. The consensus of the Board was that it <br />was appropriate to require a fee to clear the accounts of those customers who <br />failed to pay their service charges. <br />The Chairman opened the public hearing.
